Hi again everyone,

Just had an email thro from my solicitor advising the following.  I quote

At the moment we cant confirm you any date regarding the devolution of the money, first of all we have to send them a list with the clients that are interested in cancelling the contract and after that we are goingto prepare the payments, because they cant frefund the deposit at the same moment. 

Of course we have to determinate a date for recover the deposit, this is something essential that has to be determinate before the resolution of the contract.

According with the contractual terms you have 15 days after the 30th jun to communicate to the developer that you wish to cancel the contract, but we are trying to do that a a friendly way, we we appreciate a prompt decision regarding conceding a new completion date or regarding canceling the contract.

We have a meeting regarding that and we are not going to charge you any legal fee for this additional work that is quite different to a normal purchase transaction, but the costs of doing the formal notification has to be paid by the clients.

Please also note that in future the developer changes his policy or if there is any problem we will see the solutions and the costs, but according with the actual situation the developer is cooperating and they seem to be open and they want to satisfy their clients.   Regards

Quite agree with you Sandra.  I dont think it is being negative but trying to get a realistic overview of what exactly is happening, what the delay  is and getting an exact date.  I myself was not in a rush to complete but it does get  very annoying when the reasons given change from week to week and there is no further work done.  Alot of us have invested quite alot of money and as long as we are kept informed to what exactly is happening then we wouldnt have to be so critical of the professionalism of this developer.  Another thing that did annoy me was that my solicitor advised 'we must stay on friendly terms wth them'  more or else dont upset the apple cart or you wont get your money back.   The problem is theyve got the trump card cause they ve got our money so until our Solicitors pull their finger out  and get some correct information and dates we ve got to sit back and wait and wait and wait.

Hi everyone,

Received exactly the same letter from my solictor.  With only the last paragh applicable to Arenal Duquesa (all phases).

I have asked for clarification from the solicitors re cancellation of contract and what the time expectancy was for the return of deposit.  I await their reply.

We already have a property in Tenerife and bought off plan.  There was a slight delay on completion but nothing like this  and we did complete on contracts even though we only had the builders supply of electric and water.  this went on for about 4 months until they switched over to mains.  With regards to inspecting the property we had no problems however over the last year a few minor problems came to surface and I got to be honest the builders came back to resolve the problem without hesitation.  Suppose we were lucky we had good builders and a good relationship with them.  Once they completed the complex they handed the complex over to the community and now we have a good president and a good forum to express our concerns.

I await reply from our solicitor with interest.

Hi everyone,

Obviously, I wasnt long speaking to my Brother because he was still out in Spain.  He is returning this Friday and I will have a better update then.  I think he did say though there was extra security around the complex obviously to prevent this vandalism.   However it will be interesting to know what comes out of the next meeting with my Solicitors and Gerens.  Will let you know once I know something.

My brother is over in Spain and rg Gerens last wk to visit site.  Unfortunately like previous owners he was not allowed to visit our Apt but could visit showroom.  He already visited site in Oct so merely whated to visit to see if there was any progress.  Alas they went last Friday to visit showroom but the Guy on site didnt speak hardly any english and like Gerens stated was not allowed to see apartment although it is finished. 

Site remained the same apart from a small bit of vandalism, lawns  had been mowed, no new roads put in and no one working on site.  Asumption was site remained as previous with no further work carried out.  A bit disappointing really.

However I have had a email from my Solicitor to say they are meeting up with Gerens in a couple of weeks regarding cancellations and will keep us informed.
