Hi all, I will try and answer as many questions as I can rather than reply to all of the individual mails as most people are asking the same questions.

Firstly:

Did I instigate proceedings before the administration?

The simple answe to this is I don't know!!!! I handed a letter to SJ stating that we were cancelling our contract as they had not provided our property by the date stated in our contract, to my solicitor in person at the end of February.  She told us we then had to give them time to respond and she would then deal with the matter. We arrived home from holiday in May to a barrage of e-mails from our solicitor telling us that SJ were about to go into administration and that we had to move quickly to get things in place before they did. After many conversations with my solicitor it was becoming apparent that she had not in my opinion actually actioned my Bank Guarantee previously and it is anyones guess if she managed to do it before SJ went bust.

Had our contract expired?

Our house was due in December 2007

Did we have to go to Spain and sign for the money And did you have to go to the office with your solicitor?

Yes to both of these.

The SGR offices are very easy to find in Alicante for anyone who needs to get there. Just make your way to  the Marina in Alicante and their office is on the opposite side of the road about 400yds up.

Hi Everyone,

I have not posted on any forums for a while for various reasons, but just thought I would let you all know that we have received, through our bank guarantee, all monies paid to San Jose. Our Bank Guarantee was with SGR- Sociedad De Garantia Reciproca De La Comunitat  Valencia. We had to go in person to their office in Alicante where we signed a note saying we accepted the payment as Full and Final and then were given a bankers draught. This was paid immediately into our bank and cleared after 2 days. We can now put this whole affair behind us. I have posted this for 1one reason and one reason only and that is to encourage those of you are fortunate enough to have a Bank Guarantee to continue to harrass your solicitor and don't take no for an answer! It can be done no matter what scare stories they tell you.

I will add some advice to this regarding your Spanish Bank account:

We were charged €70 for the privelage of paying the Bankers Draught into our account!

When I arrived home and tried to set up a payment from my Spanish account into my Currencies Direct account, I was told by my bank that I cannot transfer large amounts of money or amounts larger than €3000 through the internet and that I would have to do it in person in Spain.

The only other way around this is by giving your solicitor Power of Attorney and they can go to your bank to sign for you!

This I believe is a relatively new rule-Because things werent complicated enough!!

I believe quite a few people are considering having a Jacuzzi on the roof but are waiting to find out if structurally it it safe to do so. If you are having one then I can just pop over the wall as I believe you are attached to us! (we are No. 37) That should save me a few bob

received this letter from SJ today. I think everyone will get one but just in case here it is:

Dear Mr & Mrs Jones,                                                                                     18 June, 2007 

In first place, and in the name of all the team that forms San Jose Inversiones, we thank you for the confidence you have deposited in us when purchasing a property in the Resort “Santa Ana del Monte, Jumilla Golf”.It is our pleasure to inform you that the construction of the properties began in the past month of February 07. At present 90% of the sanitary forged on plots R-4 and R-15 have been finalized and soil work has commenced on plots R-7, R-10, R-14 and R-16, and later proceeding with these same works on plots R-17, R-19 and R-20.

 Shortly we will commence with the rising of the structures on plots R-4 and R-15, therefore, we estimate the delivery of the first properties during the first trimester of 2008. During the next months we will confirm the completion dates and periodically,  inform you of the advance in construction of your property. At present, the fences delimiting the perimeter of the golf course, as well as the entrance porch with the security centre and infrastructure are also being done. 

As far as the 2 golf courses included in the Resort, we confirm that the moulding work of 9 holes has finalized, proceeding during this month of June 2007 with the installation of the irrigation system and later sowing of the lawn. Continuing the moulding work for the rest of the holes, being the summer of 2008 the approximate opening date of the first golf course. Further ahead, we will confirm the opening of our second golf course. 

We are in contact with the Golfing Federation in order to arrange the different tournaments that will take place at these golf courses. 

With regards to the Social Club, the project was presented, displayed and accepted, by the Town Hall of Jumilla, a few months back. The beginning of work for this spectacular building is predicted for September 2007. Also, the first great shopping centre will also begin with construction before end of year. 

Soon we will be able to inform of  the date of construction of the equestrian centre and other activities, like sports grounds, tennis courts, football pitch and other servies, such as a petrol station, garden to centre, etc… which at the moment are in planning project.
