Hi Maria,

Just a few lines to say thank you to your and your team for winning our cases against BBVA, for the return of our money we thought we had lost on the property in Jumilla (Santa Ana del Monte).

Hopefully SGR will not go ahead on their application to the Supreme Court and we will not have to incurr any further cost their.

It has been a long road but worth the effort and we would be happy to recommend Costa Luz lawyers to anyone looking for quality representation in Spain.

Hi Maria,

This is great news and well done to all at Costa Luz lawyers.

SGR have appealed our case to Supreme Court (we are waiting for date). BBVA did not appeal to Supremem Court. We bought from Herrada Del Tollo in Jumilla.

So far we won initial court ruling and were awarded costs in Initial court case. BBVA and SGR appealed, we won again but our costs were not awarded.

Does/Could this SC ruling mean that if/when our case goes to Supreme Court (and if SGR lose), that we could be awarded all our costs again? Or in the case listed below, were that client's costs awarded at all stages?

"CAJA CANARIAS (now BANKIA) SENTENCED BY THE SUPREME COURT TO REFUND ALL OFF-PLAN AMOUNTS PAID BY OUR CLIENTS PLUS INTEREST & COSTS"

That is great news that the appeal was won. However can you explain how why the buyer was not awarded their costs for the appeal. 

Dont get me wrong I would be very happy to get our deposit back. I am just finding it hard to understand why, when you are not in the wrong and you "win" the appeal you are not awarded costs. Is this the norm or were there particular nuances in this case as to why costs of the appeal were not awarded.

Hi Karen and John,

The court case went as well as could be expected.

We are with Maria and the barrister on the day was Fernando. He was excellent in our opinion.

We were questioned by the barristers for the Insurance company (SGR) and some of us by the bank (BBVA). Mostly questions were to do with the bank guarantee; who we believed was to issue it, who it was with, etc. Were our contracts cancelled, did we have a court order to say they were cancelled.

Mostly questions they knew the answer to, but were trying to confuse us or catch us out. For example we are on the list of creditors and can only be on that list if our contract is cancelled.

As we voted Yes to the creditors agreement the SGR barrister was trying to make out that there was still time to receive this refund. However our barrister said in court there was no way this money was coming back from the developer in July as they do not have any properties sold, so cannot fund returning money to us. This seemed to be an issue with our particular case.

Fernando presented several cases to show how other judges had found in favour of our side and the SGR/BBVA presented some showing the opposite. However theirs were from lower courts.

We started the process of suing the bank in 2011, so it takes time to get to court. I am not in any position to give advice, having made several mistakes with this development. However the best decision we have made so far was to contact Maria at Costa Luz and fight to get what is rightfully ours back.

If you can get several people together it may bring the costs down.
