Last call to regularise the declaration of your pensions!

Time is running out !! Very little time remains for you to regularise the declaration of your pensions


In our December article we informed you about the second chance being given by the Spanish Tax Office to tax residents in Spain, who have not previously declared and paid taxes on their pensions there, to do so.

 We know that the tax office have sent thousands of letters to taxpayers informing them of this option and of the penalties to be imposed if they are not regularised voluntarily, as, due to the internationally agreed exchange of information, they have the information necessary to enforce the regularisation themselves, but this would incur surcharges and interest etc.

 We remind you that the deadline to regularise your tax situation ends on 30th  June 2015, so you should contact your advisor without delay to make the necessary returns, and this will avoid the application of any kind of surcharges or interest.

Returns should only be filed in the event that you were tax resident in Spain (ie for those years in which you have spent more than 183 days in the calendar year in Spain), and in which you have received pensions that have not been declared, assuming that they were tax exempt or that they had been taxed in their country of origin, when indeed, they should have been subject to Spanish Income Tax (mainly private pensions).


It is very important to remember that, if you have already filed an adjustment to your pensions and the tax authorities have charged you interest and surcharges etc, before this measure came into effect, then you can claim a refund.  The deadline for this claim is also 30th June 2015, after which time you lose the right to do so.

There will still be a hard core of expats who insist that they can choose where to pay their taxes etc, and prefer to take the chance of not being caught
