FRUSTRATED EX SPANISH HOUSE OWNER
| The Comments |
We sold our spanish property in November 2008 and submitted form 212 in April 2009. the form was prepared by our solicitor, taken to our bank form them to complete and then (we presume)sent to the spanish tax authorities. So far we have received nothing although we left open our bank account and have paid charges basically for not using it.
Does anyone out there have any idea how we can chase up the 4000. euros which we are owed, We have spend hours on the web trying to find any clues of where or who we can contact. We miss Spain and would like to buy another property but are not prepared to give Spain any more of our money until we receive what is rightly ours. Any suggestions would be greatly appreciated.

You did not say what area or tax office?
If it's Malaga they are not paying out any money at the moment and are hardly processing returns at all - they say they have no staff to look at files due refunds!!!
Either you or your lawyer or gestoria will have to go in person and ask what's happening with your file.
Ask you lawyer to drop in and check status but he will know he is wasting his time and will do so only when he has other business there.
Were you up to date with non-resident tax returns becuase that could be a reason for the delay.
Or you could just gift the money to the government in their moment of need.
But if you owe them money they will immediately apply surcharge and chase and embargo bank account or property.
