Hi people!!
Can anyone help me????? Me and my wife like lots of people paid a large deposit for a villa in Jumilla with San Jose through a UK based agent in 2006. Because of the situation at Santa Ana we decided to change site to Playa Golf 3 the same property was over 50k euros higher but we managed to agree on a price which we were more than happy with, so we decided to exchange befor San Jose went into liquidation, the paper work is still going on for the transfer but I wanted to know if we should have any problems with our transfer considering the position of San Jose? Can anyone help me answer this?
Has anyone brought with Atlas International on the Santa Ana Site??
We hopefully should be moving to Playa Golf 3 R3 Dose anyone live near there??
Dose anyone have a big villa with pool for us to rent around mid June? if so please let me know.
We cant wait to move in , hopefully things will get sorted out.

Hi Dal - I think there are quite a few people in your shoes - you should go onto the main forum for information on the San Jose situation. I live on Playa Golf II and have certainly seen a lot of San Jose vans around over the past few days so they are still working. You might have some delays if you haven't fully completed on the new house - ask Maria de Castro if you need legal information.
There are lots of properties for rent on PGII if you want to be near your new property. Not many with a pool but there are lots of pools on the development. A quick drive around would give you lots of rental agencies but I used Podehall when I was renting out my house before I moved out permanently - they were really good. They advertise on this site.

This email is for those buying a property in Spain from the developer San Jose, such as on the development Santa Ana Del Monte in Jumilla.
As you may already know, San Jose this week applied, voluntarily, for court protection against it's creditors. They blame the credit crunch and market conditions for their demise.
This now means that anyone who has put a deposit down on an off plan property through San Jose essentially has to join the creditors list to try and get their money returned.
We know most people don't even have bank guarantees so this is particularly worrying for them.
This is going to be a long and complicated process with no guarantees of success. At this stage we don't yet know the actual state of the finances at San Jose but group action is now called for to try and recover as much as possible from the developer.
Now, we have received many emails from worried people this week in total disbelief that they could lose all their money here. So, with a couple of contacts of mine we went to see the UK law firm Irwin Mitchell yesterday (www.irwinmitchell.com). They are a huge company with huge resources and with huge experience in these cases. We went to see them to see if they could apply their formula to this case. They have branches in Spain.
They have agreed to hold a meeting next week to explain to people what the situation is, what the options are and what action they propose.
They explained that there are essentially three groups of people here:
1. Those with bank guarantees should be ok
2. Those with no bank guarantee but did use a lawyer (can possibly sue lawyer)
3. Those with no bank guarantee and no lawyer
They have set a provisional date for a meeting in their offices in Birmingham on Wednesday 21 May 2008. They need to know how many people would be interested/ are able to attend.
This is a very serious issue and this is a good opportunity to meet other people in the same situation and to ask questions as a group to these lawyers who have been through this before.

I hope you can attend the meeting. I am very pleased that this company is willing to take on this case as they know how complicated it is dealing with so many individuals, each with their own unique circumstances.

I have already filled out the form and because I live in Birmingham i will be going to the meeting on sunday. I have been assured by my agent that my exchange to Playa Golf 3 should not be effected but i havent had that in writing at the moment, just a waiting game. But if anyone knows of a big villa to rent privately let me know.
If anyone has contact with the owners of the Sharabi bar ( Jaz i beleve) let me know, I think i met Jaz`s wife out there but didnt get a chance to meet him. If anyones got there number or e-mail that will be great.

Hope the meeting was a success. Regretfully we couldnt attend (Wednesday we could have typical!).
Although we have already decided to transfer to Playa Golf, we look forward to reading about the meeting.
Our Contract has been drawn up and duly signed and like you, its now just a waiting game....

Seems to be quite a lot more activity on Playa Golf 3 with regards to sales interest..For some months we have seen little movement but just in the past week or so, things are looking up !!

Hi Fred, welcome to the Eye on Spain forum. There have been lots of posts regarding San Jose and people who have been left with empty promises after paying their deposits. Some have been asked if they would like to relocate to Playa Golf. I have posted to tell them about our urbanisation so maybe we might se some of them moving in in the next few months.

Hi Joe. I don't think we regret buying here and whilst things have gone pear shaped for San Jose, we are still able to enjoy what they have created. I have been in contact with a couple of new purchasers, just today, who are moving on to R3..both on the internal road between yours and ours so it looks like the sales teams are still active.
I did hear today that the banks have re-financed San Jose with a wish they continue trading albeit whilst holding much of their land bank as collateral.

Hi Alan - if you go to the San Jose website it looks like they only do that model on PGI - www.sanjosegrupo.com . They don't give prices but there are contact phone numbers and email details if you wanted to contact them.
Also, if you google amapola playa golf you will find a few companies doing resales which should give you an idea of current prices before you talk to San Jose.

Hi folk, we rang Pilar direct and requested an emailed list of all properties available on PG 1 II and III. and it includes 'list prices' They sent it the same day and we were able to secure a Jazmin within days of flying out (7-14th May). They were (not sure about now) able to negotiate very well and we feel relaltively happy with the price we paid . We checked all local Estate Agents boards for the price of re-sales of SJ properties and have paid a competatively low price in the current market situation. Pilar yesterday emailed confirming that we should not worry it will all go through.. just a waiting game now (though not so traumatic a feeling of not making a decision at all). .
The activity 'after the news' on the site was the most residents had seen in a good while so I think many like us are deciding to safeguard deposits this way. The residents were so friendly and we've made some good friends already in a week. Looking forward to having our key soon (Law etc. willing!).
It will be a lovely community !
Best wishes to all who are going this route and unlike the comments made by Tony we are totally respectful of others decisions to go with hoping for SADM. We are just saying that there ARE other options and opinions in this open Forum We hope its not a case of 'if your not in then your out' we are not gloating in the slightest, in fact we desperatley wanted SADM its why we purchased, but simply not prepared to wait any more years tis all. Besides which.. we havent got the key yet!

Hi, Everyone,
We too moved our deposit from SADM to Playa Golf just before the liquidation.
We had waited three years and decided we just wanted a property that was built. We did our homework on prices then negotiated a discount which we were happy with, then went ahead.
This situation has slowed everything up so we havent completed yet.
It wasnt an easy decision to make as we both loved SADM, but, we had an apartment in Spain which we had sold to finance the purchase at SADM and weve really missed the "home from home" feeling having your own place gives you.
We have friends who are still going ahead with their purchase at SADM, and Im sure when we visit them and we are sitting on their terrace looking at the beautiful Santa Ana mountains, that we will have a tinge of regret, but for us this feels like the right decision.

Fingers and toes crossed for you! Do you mind saying which mortgage company you went with? Totally understand if you dont wish to state.... Our Lawyer (Iberbrit) are looking at Barclays but suggesting SJ's own bank BBVA for ease and possibility of being quicker.

Here are the details of the guys that is setting up our mortgage, the chaps name is Mike, hes very helpfull and dosnt charge a penny, the actual mortgages is with Lloyds TSB, Mail him and say youve chated to me (Dal & Raj) hes aranging a 80% mortgage.

incidently, LLoyds TSB are opening a new office near to Playa Golf..They put up the glazed windows last week and are busy fitting out the place...Opening in June so have been told.

Weather brilliant at the moment, Hot sunshine and warm evenings...
The road works along the N332 are ongoing with very heavy machinery almost from Pilar to Torre... Just how they manage to move so much earth / rocks without ever closing a road off beats me !!
The 'Whiff' we get at times is something you seem to get all around Spain... It can be a bit strong at times just at the roundabout near to La Ronda C.C but not overpowering !!
Down on R3 or R4 it's hardly noticable... ( Or has age affected my senses ? )
