We are new to this forum. I wish I'd found it years ago.

Is there anyone out there who bought the Green Hills apartments that were not built. We bought in  August 2003. We had been monitoring progress on the internet thinking the pictures we were looking at were representative of the whole development. We turned up in Elveria about the time the apartment was due to be finished, (Aug/Sept: 05), with the intention of buying the furniture, only to find nothing built.

Imagine our shock. We have been battling to get our money back ever since. So far we have had two court dates cancelled and we are now being told that the next date might be in September - hopefully. We would be happy to discuss the situation and listen to advice from any other people out there in the same situation as ourselves. 

It would be good to compare notes and discuss how various solicitors are handling the situation.

Hi - Our story is identical to yours re. our purchase of appt. in upper blocks at Green Hills (including watching progress on Eralia's website not realising it was the lower blocks!  Would have been 'nice' of them to have made that clear).

Like yourselves, we found out in Sept. 2005 that nothing had been built (we were telephoning to ask if it was too late to choose the colour of tiles!).  Eraliamade out that we were the only ones they had 'forgotten' to tell.  We have since found many other purchasers were in the same boat re. not being informed.  It was just a way for them to hold onto our monies for as long as possible.

We are fortunate enough to have found a great lawyer (we sacked our original lawyer who was obviously in cahoots with the developer) who finally took us to court last Summer to enforce our Bank Guarantee, and we received our monies back + legal interest.  We feel very fortunate.  We know of two other purchasers who received their monies back, but because they had lousy lawyers, did not receive any legal interest which they should have done.

Our lawyer was successful again last week for another purchaser from the upper blocks - monies returned with interest....finally!!

I do hope you have confidence in your lawyer, that he/she is independent (not recommended by your estate agent or developer).  If you want to pm me with more details of your case, you are welcome.  May be able to help with more info.

MrC Thganks very much for the information. Like yourselves we were told everyone's solicitors had been informed. Eralia even showed us the list they had sent to various solicitors. When we asked our solicitor he said he had been told that we were not affected. I am sending you a pm for more info - I hope you don't mind!!!

Hi I have just found this site by luck I am in the same situation supposedly buying an apartment in one of the top blocks that was never built and I was not informed, I found out purely by accident when I was speaking to an agent in Spain (not the one I purchased thru). We went to court last September and finally got judgement in Nov but still have not seen any money and now our Solicitor has gone back to the court to get enforcement and seize assets. I was told that the bank guarantee was never put in place although at the time of paying the deposit I was told it was. So it is interesting to know that Mr C got his money back via the ban guarantee. Unfortunately my solicitor was recommended by the estate agent and I'm hoping it is not the one you sacked who was in cahoots with the developer. Any comments greatly received.

My husband and I eventually had our deposit +legal interest + costs paid to us after a 2 1/2 year battle ! We received the final stage of our money in Dec 2006!! I am surprised to see that there are still people who bought on the upper level of GH that was not built, have not had their money returned. the developers lawyer stated a long time ago that everyone had their deposits returned. We formed a large group to take action against Eralia  consisting of both upper and lower level properties. We are still an active group.

We persued the bank not the developers for our money. We knew they did have the resources to pay us!
