Tish are you actually talking about Santa Maria Green Hills?

We have purchased an apartment there, Eralia have been fabulous and very accomodating. They have assisted us every step of the way. The apartment is exactly as described,  the gardens and communal areas are maturing nicely.

We had a very small snagging list (small scratch on front door, ensuite plug didnt fit in sink and scratch on mirror) this has all been sorted.

Eralia are not renewing the bank guarantee as this was to protect us against the apartments being built (1-11 are all finished)

It is a fabulous development exactly as described

I am new to the Forum.

I bought in Santa Maria Green Hills in April 2003. In February this year i asked my lawyer to try and get me my deposit back, as my apartment had not been built as promised. I  bought SW facing apart in block 10, for maximum light, as i was relocating to Spain for health reasons. However block 10 was built on the side of the hill, and my apartment at the bottom, so although the lounge was SW, the rest of the apartment is very dark, and the main enterance is down steps, just like a basement flat!! i would never have bought had i known the plans!! This was supposed to be my Dream Home!

In September 2006 my lawyer told me that he was trying to get back all his 7 clients deposits who had bought in SMGH, as the license of First Occupation License wasn´t going to be granted at this present time.

A few days ago i received a Document, from my lawyer, to say that after several attempts to get our deposits back, the Developer refused each time.

He said the only alternative if we didn´t want to Complete was to take the Developer to Court. The email also stated that the judge had 15 months to make his decision!!

I have made an Appointment to see my lawyer on January 11th 2007, so that he can go through everything with me.

I would like to hear from anyone who bought in the lower blocks, and who has got their money back.

Although my lawyer has been helpful and understanding, i am rather concerned that if my lawyer tries to get all 7 of our deposits back, it might well go against me, and it might be more beneficial if i was one on my own.I am also not happy with the length of time the judge has to make his decision, as i am unable to make any decisions concerning property until i know if i am able to get my deposit back!

I would wecome comments from anyone who has been successsful in getting their deposits back, and which lawyers they used.

 Sorry I will try again.

In 2004  I was buying into this development.  I am now taking legal action to have my deposit returned as there are problems with no  Licencia de Primera Ocupacion being given by the Town Hall.  I appear not to be alone in this action  My solicitor has advised me that many people are not buying there now.   When I last visited the site there seemed to be very few apartments occupied. It is not how I thought the development would be. I would like to hear of others who have their deposit back. How long did it take?  Brandt
