People!!!

You can have whatever you want (as a community).  If you vote to paint the buildings every 6 months, then you can have them painted every 6 months - you may not like the hike in community fees though .

I have already painted my apartment, I am not very good with water colours and it does look like a 4 year old has done it. 

Still it looks nice on my fridge!

As someone suggested in an earlier post if you want to know the answer ask ML. I did and received an e mail stating the exteriors of the apartments will be painted after 5 years so will be done in 2013. I appreciate it does not seem feasible they will all be done next year but there is an indication that it will be done.

 There is a painting committee in place and Ml confirm the painting will be done next year. All appts will be painted whether already done or not as they dont want alot of different shades of white. However there probably isnt enough money in the kitty so dont be surprised to get a paint bill.

Just so the Community, as a whole, doesn't get caught more by non payers:

 

If the costs for re-painting can not be met by existing, or future, community funds: then the community fees will have to be raised, somehow (even if only for a short while), to pay for it.

Now, if these increases represent a charge of more than 3 months fees, then non payers have a 'legal' way to advoid them: 

Clause 2; Section 11, of the HPA:

Where resolutions are validly adopted to carry out improvements that may not be imposed in accordance with the provisions of the last preceding subsection and whose cost of installation exceed the ordinary common expenses for three months, dissenters shall not be bound, nor their fee modified, even where they cannot be deprived of the improvement or benefit.

I am a new owner coming out to furnish soon and move over within 12 months.

Leaving England is mainly due to people not paying their share and causing high tax payers like myself to fund the shortfall.

 

Please tell me this isnt the case on CDA................

Ok some details.

The staff in the office are mainly there to sell mileniuns services and probably don't even have a working knowledge of the budget. The statutes say the community should paint the facades every five years so that would be their stock answer. The only person in the office who knows the budget in detail is Juan Carlos the accountant who doesn't speak to owners much, in the past two years he, Agustin and Juan Lopez are the only ones that I have spoken to regarding details of the budget.

There is no money for painting, this has never been a budget item in the past and we have no reserve fund.
I allocated some money in the interim budget, from June to December, for painting. This come from saving from the creation of the urban entity. This money would only of been enough to carry out remedial repairs to the worst effected paintwork on the resort. Changes that have been made to the budget in the past month or so would of wiped out this money so I think the painting allocation may have to be removed.

The painting come under maintenance rather than improvement so all owners would contribute.

As has been pointed out we can paint as much as the owners decide, we just have to increase the fees to cover the cost.

So far no prices have been calculated for the property painting, so let's take a rough guess and say around €120 per property ( just a guess ). So this is €10 per month on the fees. Realistically as we have 3250 odd properties we unlikely to paint them all in one year. The statutes say every 5 years so we could have a rolling program and paint 20% each year, this would mean around €2 per month on the fees, which seems reasonable - would just need to be passed at the next AGM. Or we could increase the fees by €10 just for next year, paint everything then reduce them again to a level where the painting costs could be spread over the following 5 years. There are many options, which is why a painting committee was created.

The last paragraph is just my opinion, as I say no costs have been calculated for property painting so these costs are just guesswork on my part. If any members of the painting committee read this perhaps they could add more details.

Thanks to ptan, for explaination,  if there is someone on painting committe, could they let me know if the painting of complex, is to include La Isla, as being of diferent colour, not sure of inplactions, but any improvement to keep complex in top order is benifical, and would be happy to contibute if it would help.

 I think it's really necessary to start painting latest in 2013, the general aspect is already deteriorating. What come across my mind is why have we not built up a reserve already? As we have some wise boys on the forum who know the statutes pretty well, why has this not been adressed already? NO, THIS IS NOT ABOUT PT! Will there be at least a provision for the budget 2013? I think with all the discussions about the legality or not of meetings or no meetings somebody should take care of the issue.

Hi all

I am a painter and decorator and have my own business in the UK. I volunteered to go on the painting committee some 12 months ago, I would firstly like to say that I have no interest in doing any painting in Spain or to be involved in any painting contracts, I merely volunteered to give my help and advise to our resort as I have 30 years worth of experience.  I have been working very hard and thought we were making progress until the last few months, when people make hurtful comments it makes you wonder why you bother, and I don't mean just Eye On Spain, when a vice president makes a comment saying a painter shouldn't be on a painting committee it certainly baffles me.

Anyway, the reason we don't have money in the pot for painting is, a few years ago a majority of Spanish presidents voted for the reserve fund to be reduced so that the community fees could be lowerd, if this fund would have stayed as it was we would of had some money to start painting. some presidents have been working really hard on the urban entity and it was looking like we would get some of that money towards painting, but I have been told that the money has been reduced and with the increase of vat in Spain, there will be none left, so the only way in my opinion we can start painting is to increase community fees and looking at some of the estimates that have been submitted it will be alot more than Phil has said,

We have a problem on the resort and I could go on all night, but the footy is starting and I'm going to the clover for a beer, happy to answer any questions tommorrow.

Wot I have done is scrape off flakey paint work and redo that spot after a bit of sun it matches the rest and looks just as good

Great thanks Phil,

so community charges apply to the resort as a whole including public spaces?

How is Condado structured, the banks own the units, and a bank JV company own the golf courses and club houses etc?

Is it a commitee which decides the comm fees?

I assume if my roof terrace fails or my windows I pay? Or if the units need facade painting the comm fees pay?
