  How many owners are waiting for a court case to hopefully secure

their deposits back

Hi

As already discussed we have been waiting since 2008 to retrieve our funds.  The case has had a first hearing in court with a second date, when we have been asked to give evidence, 14.2.11.

Similar to the last posting-first hearing has happened with no result. I have been called to attend on 01/02/11 fr the next hearing.

Good luck to you all attending court for your monies back.We have been waiting for five years now for our property and had the money in the bank for all this time.We bought a property on phase seven five years ago and after a £50.0000 deposit speaking to solitors etc  they say it would probably cost as much again in fees and probably two to three years to persue it through the spanish courts.We are not giving another penny to the spanish (Or Euro) Piensa have said that if we do not pay the remainding balance by the end of January 2011 they will sell the property on.We are shocked at the system over there.They are discusting.

We can just say goodbye to hard earned cash for a dream that will never happen.Regards and again good luck with your court cases.

Not sure what you are getting at here, your house is now ready for you to move into but you don't want to now !!!!

We can just say goodbye to hard earned cash for a dream that will never happen.

If it is your dream what has changed in the last 5 years & dont go on about the euro & the Spanish economy (think of another excuse), if you stand to lose your hard earned cash why not sign for your new house on CDP. I know you all will have a dig at my reply so please go ahead. Dont forget one life so live it Ha !!

I agree with you firestorm, why would you now pay the full amount for a property that is not worth the original price also loose money in doing that with the decrease in the exchange rate.  This would be madness.  And certainly for us we had a plan to move to spain at the time of purchasing the property 4yrs ago.  We have now made changes to this plan that no longer include spain because of the lack of property or funds that were tied up in the deposit.  So at one point we too had a dream which was to move to spain and live 'the dream'!!!!!!

This may sound like an 'excuse' to some who sit very smugg in there spanish properties.  However it is a very real nightmare we are currently living with the risk of loosing all of our hard earned pension!!!!

I sympathise but that's the chance you take when you sign up for offplan.  If it was your dream 4 years ago why didn't you buy an existing property.  We have bought offplan in the UK having delays of 5 years.  The contract even in the UK is completely biased towards the builder/developer.   There's always that hope that the property will be worth more by the time you collect the keys.  This time it didn't work out that way.   We took on a euro mortgage, Interest only, (to take advantage of the low interest rate) then the price in the short term is the same and who knows, in the future, the exchange rate may rise again and we can pay a lump sum in. The quality of the houses are still as high.  A similar new property so close to the sea in the UK would cost a lot more not to mention the solar gain and cheap vino.
