All.  

Some alarming news, the La Tercia Real forum reports Peinsa has gone into Voluntary Liquidation.  

Does anyone have any more information?

you will see Gordon and Lisa saying that their solicitor has not found any evidence of the liquidation claim so far.
What does appear to have happened is that construction company Obralia has filed for bankrupcy protection- see:

CDP buyers should know the name as it is the contractor who built the western side of the site (Etosa is the contractor working on the eastern side).

Definately one of the main building contractors rather than the builder directly:

"The Obralia construction company run by the man who won the young businessman of the year award last April, has filed for bankruptcy protection.
The 36 year old founder and President of Obralia, José Gómez, has been unable to avoid bankruptcy given the economic slowdown in the industry.
It comes as Obralia has five housing and shop developments currently underway in Murcia, including a resort in Corvera and two other developments in Alicante.
Workers arrived at the sites yesterday to find themselves locked out. The company has issued a statement calling for calm and said that it would attempt to pay creditors reasonably".

Concern will be how much of Obralia were contracted to do the development, are they contracted simply for the build or greater, such as painting, pools, electrics, finishes etc.
Also depending on what happens next, the implications on the build guarantee - normally however they will be underwritten in the event of such instances.
Would be useful to understand the implications of the action taken on the development.

I too have contacted my solicitor this morning and he is satisfied that Peinsa are ok. We have been in the process of having our bank guarantee renewed and that has now happened, so it's highly unlikely the bank would re-issue a guarantee if the company was insolvent.
By coincidence I have also bought a property in another development mentioned by Rowleyhouse - Corvera Golf and Country Club near Murcia (The developer is Calidona not Peinsa thankfully and they are altogether a more professonal outfit to deal with - regular updates offers on air con, furniture, rentals programmes etc). By conincidence also however, Obralia were one of the builders on site. Apparently they were contracted to build about 20% of the development and those properties will now be taken over and completed by the other 3 developers on site.
In the case of CDP Yolanda tells me that a new uilder has already been engaged to complete Obralia's side of the development. I'm sure this will result in some other minor delays but the bigger worry is the standard of workmanship which may declne. Obralia certainly were improving with each phase and hopefully the new builder will maintain that standard.

Could someone living in SAN JUAN PLEASE PLEASE PLEASE try and get some sense out of that so called site office. We have just come back from a fantastic week there with the whole family, met some great people and were as pleased as punch, over the moon with the houses. We were told by honest  !!!!!! Yolanda (ha ha) that everything was great we should be in phase 7 by Dec/Jan and the program should be all finished by the summer ( 2020 I now think) then I read all these very frightening stories I think we all have had enough of this **** from Peinsa over the years. I am now in the process of contacting my solicitor to see how I can get my money back or take the ************ to court. Thats enough from mad mick tonight, I am now going to the gym and head straight for the punch bag.

we understand your frustration. we freaked, emailed the site office and got this reply  :

Good morning;
If it is true that one of the builders we were doing the houses are in bankruptcy, but only affects the last 2 stages, at this time we have hired a new one so that there is absolutely nothing to worry about. Your home is more than complete. While awaiting shipment soon.

Thanks for sharing information sent from Yoliaranda at the orifice, What do you think she means by the last two stages. Do you think it is the phases of the houses or the shops in front of us ? as I said our house looked finished apart from the roads on 27th Sept when we were over there and by the way the site was deserted the whole week we were there, yoliaranda told us then of course the builders are working you just can't see them !!!! Pam and I just collapsed on the orifice floor I think you must agree she is the Special one. Well must dash got a few PMs to read should be interesting hope to hear from you two again I hope.

Hi

Just been reading the frightening posts, we have bought one of the apartments due to be built in Oct 09 (previous was March 09) still waiting for the bank guarantee, so really worried now ! as I would say that the apartments will be one of the last phases .Has anyone seen any sign of the apartments starting to be built. They should be below the apartments that have already been built next to the Beverley Hills. Has anyone actually manage to contact Peinsa, other than the local office.

We are all in the same boat here and it seems to be sinking very very fast, as for Peinsa I dont think they really exist. Patricia and Yolanda are two little Pixies and the so called builders are all little elves, building make believe homes for unsuspecting humans who are suffering from a so called credit crunch. But really we were all put in a deep hypnotic trance by the two pixies when we first entered there little cave (office) and were told that all these lovely homes were going to be built in San Juan so they sprinkled us with fairy dust and we then handed over all our cash and the most important part of the story is we handed it over freely and felt good about it we've all been singing and dancing in the streets and bars for the last 3 years. NOW THE SPELL HAS BEEN BROKEN AND WE HAVE ALL WOKE UP !!! MY GOD CALAS DEL PINAR DOES NOT EXIST.

I think I'm stressed, out apoligies for going on I think I will go and have a lie down!!!!!
