Hi everyone 
Heard from my lawyer twice within the last two days. The foundation problem has been solved and work has started again.
She has been told completion in 6 months but dont hold your breath.

Hello Again, After reading the last message this morning i sent an email to our agent asking them to look into this!! they have replied with yes the build has commenced but completion still not for 18 months they have received this info today from the builders, Regards Daphebba

Just goes to show you cannot trust a lawyer. I will ask her to check her timetable and also to try to get some photos

not a lot to report really site pretty much as earlier photos with foundations in and some cabling etc. Spanish holidays have now begun so not a lot happening but we have been assured by the builder (and we have no reason not to believe them) that as soon as August has gone the build will continue and completion will be in 18 months. Beautiful place, very very hot.

Hi Everyone

I have just heard from my lawyer. The new foundations are complete and the structure is about to begin. A tower crane is on site and all the materials
are near to the plot.

Hi everyone,

We have just returned from a disappointing trip to Garrucha. Unfortunately there was no work happening on site despite visiting every day for a week. No-one seemed to have any anwers as to why this was the case. The surrounding area has also deteriorated a lot with graffiti giving it a general run down look. We have come back to reconsider whether we pull out or not as it would not be possible to complete the build from this stage in less than a year.

On a more positive note resale property in the area seems to be slowing down in price and this may be the route we take now.

Hi everyone
I'm spanish. The works haven't start.
There are legal problems for building there, so I canceled the contract three months ago. They don´t want me back the money and my lawyer will sue them.

Hi all we've just spoken to Dominique at mar y casas on the phone and she tells us that work had stopped and that she believed that there is a problem with the foundations......  Any thoughts anybody???????

spoken to my lawyer who tells me that men were seen on site using concrete. Not sure whether to believe or not.

I will go to spain early next year to kick some ass

I was with my soliciter on the 3rd december, and had a meeting with Medsea and the builder the same day.  At the end of the meeting they came to a conclusion that the build would not be ready until 2010.  I have started the procedure to pull out of the build, since the builder has been in breech of contract since May 2006.  I was also told by the clerk in the Mar y casa office that the original project had been scraped and re-started again due to engineer report on the foundations and support pillars.  the time that i was over there no one was on sight, and the had'nt looked like there had been for some time.  They could not even give me a date when the project was going to commence again.  When i left the so called meeting laughing at such a joke this all was, to be informed by the Medsea rep that the builder does do good work, having finished and completed two projects in Turre and Polimaris, which were passed and started after the La Atalaya build.  In fact the Medsea rep told me that the two projects only started two years ago.  Dont hold your breath for 2010.

We have jumped ship too!  We decided to cut our losses and are not holding our breath about getting but the deposit back, but feel it's the best thing to do in the long run.

Hello all. My wife and I have just stumbled accross this webiste this evening.

We too are one of the poor clients who agreed to purchase a property in La Atalaya. We paid an initial booking deposit of 3,000 Euro in March 2006, and signed the contract. A further 30% of the purchase price was requested and this was paid in May 2006. We bought through agents who we found on the internet. Contracts were signed in Mar y Casas offices at the roundabout between Vera and Garrucha.

At this point we are extremely disillussioned with the continual delay and endless excuses. Mar y Casas are completely useless and provide absolutely no info. Our agents do keep us updated every 2 / 3 months,but like the rest of you, the updates refer to additional licenses required, issues with foundations etc. etc. etc.

We did push for a bank guarantee in 2006, and did receive one for 41,000 Euro. We have paid almost 45,000 Euro, but feel at this point that we should just jump ship and take whatever we can get.

Do you think we will need to hire a solicitor to obtain a refund of the monies guaranteed ?

Mar y Casas have built in Palomares  they have  sites finished with some apartments not sold. You could always approach them and ask to transfer your monies paid to one of their finished apartments,  with sales slowing you could get an apartment at a really good price especially for all the hassle you have gone through. Of course it would depend if you liked the area and the apartments of course.  Just a thought . At least you would have a property  you could use now.

Do you think it would be worth us putting a united effort against the developer and trying to get all our money back.

A "united" front to get your money back is always good. The process however is not quick if they won't agree and you have to take action against them. Its also not cheap  the more of you  the better  so you can share costs payable to the solicitor etc.

You could try getting your solicitor to send the builders a Bureau Fax (this is a legal document )stating you wish to end your contract due to what ever your circumstances are (breach of contract etc) giving then 15 days to reply.  See what happens. After which if nothing you could go down the legal action route . You may be lucky they might just pay up.

What ever you decide hope it all gets sorted out. Believe me I know how stressfull all this is.!!!!!!!!!!!!!!!!!!!

I have just received another email from mar y cas stating that work is starting this week

I dont believe them as we have had many stories. My solicitor has contacted them and they
cant do anything until the week after easter. fingers crossed
