Legal tip 797. Victory with Bank action in Corvera by CostaLuz-De Castro

For a phase 3 client, who had a guarantee covering just part of the payments he made.

Judge, using theories of Banks liability for the full coverage of guarantees, in complete protection to the buyer, has condemned Bank and developer jointly and severally to pay all amounts the purchaser deposited into the developers account, plus legal interests since day he made payments---5 years ago--- at a 4/5% rate.

Legal costs being imposed just to the developer.

well done maria and team, we bought off plan on Corvera back in 2005. we paid a deposit of 40000 pound, that came with a bank guarantee, yet there is not one bank in the land that will give us a morgage,on the properity.The site is half finished ,with no hotel and sports complex, that was promised in the advertising campaign.
please can you tell us ,now that the courts have ruled against the banks and deverloper,what do we have to do to get our deposits back? . I do hope you can help as we are desperate now ,and hearing this news has given us hope . thank you again mrs hendrie.

Waiting for courts to hear my case against Phase 3 Corvera now for 2 years. Are my lawyers not doing their best to get it heard? Is the backlog now easing in the courts of Murcia?How can I hurry things along?
