With rereference to your legal tip 1032 "do not rush into signing a deposit contract", is the National Institute of Consumers a regulatory body and do they have the authority to instruct the Bank of Spain (and their entities) to immediately comply with provision 86.1 of Spain Consumers Act that you identified, before this gets out of hand (i.e. before large numbers of consumers become exposed to this abuse?)

Or do we have to wait until large numbers are affected before the National Institute of Consumers would instruct the Banks?

I'm worried that this Institute may be like the Banco de Espana (BDE) and have no firm control over the Banks,as Keith Rule identified back in 2010.

I understand the need to identify a contract that eliminates these abusive clauses Maria, but consumers will remain at risk so long as a regulatory body does not take action and effectively penalise any Bank (or Banking entity) that continues to include these clauses as default. Penalising the Banks/Banking entities has the potential to act as an disincentive if the penalities were scaled appropriately .
