We took San Jose to court July 2nd 2007 and won the case. We should have received our deposit back, plus court costs.  Unfortunately, we have received nothing. 

Can anyone advise us?  our Spanish solicitors are now asking us to pay the court costs and advising that we will get it back eventually when this mess is finally sorted out. 

Should the courts not be on the list of creditors and have to wait with the rest of us? With no guarantee of receiving any money back, I feel we could be throwing good money after bad.

Went to court  July 2007 re refund from San Jose the judge found the court hearing in our favour September 2007. However San Jose have appealed and it can  take another year. The contract is not worth the paper it is written on, the developers are totally unscrupulous and they have never heard of customer care.

We are new to this forum but would like to let you know that we took San Jose to court in July 2007 having purchased a property in El Pinet in 2003.  In September 2007 we were informed that the Judge had ruled in our favour and we would be refunded all monies plus costs.  However San Jose have appealed and this process could take another year.  At court we learnt that  planning permission had been withdrawn before we even signed the contract.  These developers are unscrupulous and have no idea about customer care what so ever.
