Hi All

our Bank guarantee was with BBVA and was executed on the 13th May after San Jose went into administration. We were told they would pay out straight away but not with any interest. Our lawyer did pursue them for the interest but they just ignored his burofax we then tried again but with no luck that's when we decided to take back the money we paid and forget the interest.

When we found out about SJ we asked our lawyer if that affected our guarantee he replied and told us that as the Bank signed the guarantee they would pay us the money.

We have a Bank Guarantee with BBVA they are willing to pay the amount stated on the Guarantee but not the legal interest is this normal, our solicitor has sent them 2 burofaxes which they have not responded to. Are they within their rights legally only to pay what is on the guarantee? We do not want to take them to court as this would take too long.

Unfortunately we are not prepared to wait amy longer and sadly are pulling out of this development.

yes we have a lawyer property should have been ready in january with another 3 month extension which means the end of april I think before we can start the process. I have heard from someone who waited 3 months but I'm not sure if that was the norm or if it could take years!!
