Hi Gully,

 This law is only valid for the “Andalucía” region and not for Tenerife. Each Autonomic region in Spain has their own law regarding the collectively used pools.
 
For example the rule that “All swimming facilities for collective use with a total water surface area of 200 meters squared or more should have a qualified lifeguard” does not exists in Tenerife (but for Valencia this rule does also exists).
 
Here (in Tenerife) it depends on other criteria: is it a residential complex or touristic? Is the pool fenced off or not?, etc.

Here you have the complete legalization regarding the collectively used swimming pools. It is in Spanish but maybe it will help you.
 
I would by the way advise you to find yourselves a Spanish lawyer on Tenerife. It is my experience that almost all complexes do not (completely) obey the above mentioned law.
