We 'bought' in June 2006 one of the first Phase 3 Flats to the top of the hill looking down 18 with the Clubhouse a stroll away, taken in by the glossy and DeVeere standards and European Tour winter plans ! Not so naive, as a banker, we checked out the Company, insisted on Bank Guarantees and got an independent solicitor. Plenty communication when they wanted the deposit and subsequent payments, then nada! Were we kept informed? Did we receive notice when work started ? ( The foundations and initial structure work is there,we photoed it as proof they had already breached the contract !) Were we informed when they decided to STOP ? Nope ! Was the original Solicitor in cahoots ? (most probably)

I didn't expect the lies, blank looks and shrugs or downright ignorance over the past 3 years ! In 33 years of banking I'd never heard of a Bank, anywhere, refusing to honour its own Guarantees !! I'd heard of plenty developers rip off their clients but unlike these smooth operators who 'negotiated' refunding the deposit which legally wasn't theirs. After the golf buggies and pro shop fiasco recently we'd had enough !! We cut our losses and had 15k of our Euros extorted so that we could get our own money back. The clearest breach of contract you could ever see. Courts that wont progress and a legal system that makes it up as it goes along ? Thank God for the exchange rate ! we got out with our sterling intact virtually broke even,  sore at the lack of compensation for all the time effort and stress caused.

We still feel the place the plan and the propects long term exist ! We couldn't stomach the thought of relying on the developer delivering anything in the end. It still took one month! from getting the legals signed for the money to clear the Spanish way before we actually recived our refund. No reasonable explanation given why it took that long either !

We weren't speculators, bought a single unit, wanted to live a comfortable retirement in a beautiful setting with sport we love on our doorstep. Best of luck to those that have settled! I for one sadly think you will need incredible resolve in the short term and a very long term outlook. I for one have resolved never to buy overseas again, once bitten...........

Just back from a visit last week to Corvera (Some photos uploaded),  9th was Fiesta hence the complete ghost town at site, Very surprised that the International Development was devoid of staff or any notice the place was shut. Security happy to let you through and browse. I know someone asked about spraying the area, on this day it was overcast but calm and the fly life was prolific !  We seen one fourball on the whole course and one novice on the Practice bays.So revisited next day as the guard on exiting said the staff would all be back. Sunny and breezy so less flies. Went into sales office and young lady seemed startled anyone came through the door. As we were on Phase 3 Pablo was the man to see, outside around to the other offices We werent asked to take a seat ! no drink no models to view, a very surly acknowledgement that Phase 3 area we visited was indeed where our apartment should be.Exactly 4 years after paying first deposit all there is was the whole in the ground and part of foundations now stopped with no estimate of completion. He did say they wrote to confirm work commenced as per contract ! Not so, then claimed wrote to solicitors, not so !. We just picked up whole file from original solicitors (We changed 2 years ago!) then finally verbally confirmed some people werent advised of work statrting No Surprise. There wasnt even any enthusiastic attempt to get us to switch to Phase 1/2 like so many from Phase 3 already Pablo said but it would be our choice only if we did ! !!!! Astonishingly he seemed surprised that this irritated us since we were one of the first to pick on Phase 3,  why hadn't we been offered a swap earlier if the deals were so good?? !! Why had there been no contact after the last deposit was paid

We didn't see any construction work at either the Clubhouse or anywhere on site. Probably six cars parked on the whole complex when so many Phase 1 and 2 apartments are complete. Customer service cannot even confirm what is happening with the large plots toward the back of the site at the 17th/18th holes in fromt of the road.

Bottom line,  we loved the site, what has been built looks very nice whats not been done outweighs any sensible expectation that this development will deliver anywhere near its potential. Based on the exemplar service to date ? The onsite cafe is a builders hut converted. The Equestrian centre is tarnished huts at the old sales office'. Hardly the 5 star development we were sold! As for the De veer hotel ot PGA Tour camp, ??

 We wont be swapping, we wont be settling, we have been forced toward legal recourse. We will wait we have no option A retirement dream in tatters. Maybe 10 yrs it'll be the place they said but I very much doubt it.  Visited the Airport site not much going on there either although you can see the tower and some works Read article its okay to go ahead by EU. Pity they didnt attach strings to sort out their construction sector.

This seems to exactly fit my situation having contracted to buy on Phase 3 in June 2006 they indicated that completion was due by March 2009 indeed original bank Guarantees for deposit and subsequent instalment expiry date was June 2009. So far not a word from the developer. Our solicitor is entirely independent and we last year provided him with Power of Attorney to progress a claim against the developer' As usual his contact is sporadic at best, we dont seem to be going anywhere and still not a brick laid or a 'final building licence'

Has any Phase 1 & 2 been compensated ? Is there a gagging confidentiality clause ? Should we now move to another solicitor who will pursue breach of contract as instructed by the client  ? Is it usual to totally ignore requests for updates and client instructions?

How can we get our Guarantees implemented when the developer is so blatantly unwilling to face up to their obligations?

At last  !!  it now looks like things will start to move and should get interesting for both investor, lifestyle and developer

I've still not even had confirmation the Phase 3 planning has been obtained, with Guarantee due to expire next month we were told to expect completion of apartment and settle by the end of March 2009.

We were early Phase 3 buyers as we didn't fancy the last options on Phase 2. Any phase 2 settlers out there yet?
