 The gardener at our comminity has, in our opinion, caused a crack in the pool sand filter.

We found that after he had vacuumed the  pool bottom, he had left the pool with the output skimmer valve for the jets closed and the pump switched on ( the multi valve was in the filtration position).   The input skimmer valve was open, the pool bottom drain valve was just cracked open and the input for the vacuum valve was closed.

We checked this out because the jets were not working at the normal time.   In the pump house we found water spirting from a crack at the bottom of the sand filter and the  pressure valve showed two and a quarter bars.

Naturally we turned the pump off and then questioned the gardener.  Not suprisingly he says that he has done nothing wrong and that even if he had left the valves as we said, there is a safety valve to release any built up pressure.   We do not know of any such valve.

We feel pretty certain that it is because of the way he left the pool that the  sand filter has cracked.

Does anyone have any thoughts on this, both in terms of are we correct in our reading of the situation and has anyone had to deal with a similar problem.    Thanks.

Thanks for your comments.

When we first arrived in the community 13 years ago the discount system already existed but at the rate of 10%.  Some owners began paying late and so the system was changed to a 20% discount about 4 years ago with a majority vote at an AGM, with payments having to be made in the month of March or September.   This has made owners pay on time in the majority of cases.   The only thing I would say is that you do need the administrator and President to be on the ball, checking the community bank account to keep a careful eye on when payments are actually made, and there have been one or two situations where there has been confusion.  On the whole though a good system.

The particular problem that instigated the potential new rule about loss of discount is that some owners, despite letters having been sent to them and rules being in place, still persist in letting their dogs run loose on community areas and foul on the grassed areas.

Good win for Man Utd today.

A situation I have found during my years living in Spain is that it is OK having rules within your community but enforcing those rules is a difficult matter without taking costly Court action.

In our community we receive a 20% discount on our community fees if we pay them within the month they fall due (March and September).  As a side issue I can confirm that this policy reduced late payment of fees considerably.   It has been suggested that we incorporate a rule at our next AGM that the discount be forfeited if an owner is in breach of a community rule.  On the face of it this sounds a reasonable suggestion but my concern is whether or not this would be enforcable and could the lost discount be reclaimed in the same way as a debt.

Thread: Community Approval for alterations to exterior of apartments

It was always my understanding that when applying for a licence to the Town Hall to make alterations to the exterior of an apartment you had to produce the minutes of your community meeting showing the communities approval for the work.

A neighbour has just informed us that he has obtained a licence to carry out works to change the appearance of the facade of his apartment but we know that he has not received the communities permission and, in fact, in the last minutes was told he had to put his proposal on the agenda of the next meeting for discussion.  We understand that all owners have to be in agreement for alterations to the facade of the property.

Are we right or are the two approvals separate issues?
