We have approached a win no fee lawyer to try and reclaim our deposit back from an off plan development that never happened. The lawyers want a large percentage of the costs we are trying to claim which we have no problem with. We thought that we had lost it so something is better than nothing. However they seem to be a bit cagey in what we would have to pay should they lose the case and costs be awarded against us. We couldn't afford to take the developer to court at the time and most certainly can't afford to pay a large amount of costs should they be awarded against us. Has anyone on eos dealt with these kind of lawyers. Also does anyone know the costs should we go down the route of paying up front for a lawyer to make the claim for us

Hi folks

We have been offered an exchange of properties from one of the apartments to a town house. The developers are wanting us to move quickly in the purchase but our solicitor is refusing to exchange contracts with them until we have the first occupation licence. I have read a few threads where they have signed up without the final habitation licence. Is there a difference between these licences and what is the general consensus on this. Any advice would be much appreciated.

Are people still getting there deposits back from Peinsa, more so any one wihout a bank guarantee. Or has any one been offered an upgrade to a better property. We have been offered an upgrade and as we don't have a bank guarantee this would have been an ideal solution. However we have already purchased another property in Spain so may struggle to get another mortgage.

Hi put a deposit down for apartment to be built in March 2009, nothing built so far so wanted to pull out. But Peinsa has now offered  us a property on a different phase; Manzana R5-1a Phase. These properties are to be built on Calle Hispasat and Calle Meteosat. Expected completion end of 2009 (Peinsas words not ours)!

Has anybody heard any thing about these properties or been offered an exchange. On the face of it, it looks like a good deal as these properties are bigger than the apartments and only cost the same amount. Don't know if these properties are houses or apartments but floor plans show 2 floors, could be solarium and garage also.

just purchased in Dona Pepa too, don't know much about area other than seem very nice. Was going to buy at Villamarting but everyone says its absolute chaos in the summertime. Coming out in March to sign up
