Regarding Tony Malpass I think he was a genuine  person but very, very naive and was taken in by Almundena who told him lies and us lies repeatedly if anyone should be sued it should be her and her cronies does anyone know if the Banks will go after her and try and get some of the money back from the asset stripping from HdT

I also received a letter from Alonso Haro Solicitors   I notice from the letter that their fee is going to be all interest gained from your Court Case, to me this is a complete rip off and should be investigated by the Spanish Authorities.  Depending on when you put your deposit down this could cost you 40% of your total money if you put your deposoit down 2006.  If you want proper legal advice contact Antonio Guilen, Gunnercooke Solicitors, Manchester he works with a Spanish Barrister Emilio Lucas, Almeria.

Has anybody out there had their Court Case in Almeria and if so have had their deposit back and how long did it take from positive Judgement to money back?

Hi Keith

Can you answer me a question.  My First Instance Ruling was to be heard on the 21 January 2016 in Almeria but I was informed prior to this that the witness from the BBVA Bank was not going to turn up so my Lawyer had 10 days to submit a letter to the Court.  This was ratified by the Court on the 24 February 2016 and I was awarded deposit back, plus interest, plus costs.   Still waiting for deposit to come back but I believe Almeria Court is very busy and bogged down.    

Now regarding the Appeal situation have been informed that the BBVA Bank appealed and was notified by my Solicitors on the 18 April 2016 they probably applied within the 20 days and obviously Almeria Court which is so slow gave them delayed information later on.

I notice on your Blog that if an Appeal is submitted after 21 December 2015 when the Supreme Court said this is ratified do you think in your opinion is it legal for the Appeal Court to uphold my First Instance Court decision on costs and award everything from the First Instance Ruling?

Hi Barry and Sue In our case the Bank did not turn up to defend the action so my Solicitor Emilio Lucas had 10 working days to submit our pleadings to the Court.   After this time a month later the Court gave it's decision and we were awarded deposit returned, interest at 6% per annum and interest paid back from the day we put down our deposit, also we were awarded legal costs, we know this because we received a transcript of the Court Judgement from our Solicitor 2 weeks after the Court decision which you should enquire to your Solicitor about and get a copy.
