We are the purchasers who Andrew refered to in his earlier message.Over 4 years ago we put down our hard earned cash as a deposit on our dream home in the sun on phase 2 El Trampolin.We are now having to go through the courts with civil fraud proceedings because these crooks decided to sell our property early last year to another purchaser.This was because as the Spanish legal system advises,we refused to complete the purchase until the property had a Habitation License or as some call it a License of First Occupation.

We had a mortgage offer from a major Spanish bank in place having paid for a valuation,but they would not issue the mortgage until this license was in place.We kept Trampolin fully informed but their course of action was non stop threats,trying to get us to use their own recommended mortgage company,putting the house up for sale and finaly selling the proprty to others.The first we knew the house was occupied was when we paid a visit to site whilst on holiday(what a nice suprise !).

Our Spanish dream has been shattered and 4 years wasted,all that we are left with is a resolute determination to make these rogues pay through both the Civil and Criminal Court if necessary.And eventualy to bring it to the attention of the media.

What Andrew,ourselves and doubtless many more to come are telling you is the truth.

We wish you all luck we wouldn't want anyone to have to go through the emotional roller coaster we have had to endure.

We posted a message on the 4th Feb 08 advising that we had received numerouse telephone calls from several of Trampolins staff instructing us that we needed to sign for our deeds at the Notary immediately .Upon informing them that we would not sign until the License of First Occupation was obtained, they threatened to cancel our contract.

We advised them at the time that our proposed Spanish mortgage lender would not issue a mortgage without this document  and that the bank in question had this contidtion as much for our protection as theirs.Trampolin at this point then tried to get us to use one of their prefered lenders who surprise suprise did not require the license.Needless to say we refused.

We were informed last week  that Antonio had instructed a 'for sale' sign to be put in our plot widow and have today been informed that our contract has been canceled and that we would not have our deposit monies returned.The fact that we are also buying an apartment on Trampolin Hills has made no difference to the level of intimidation we have received and the nasty tactics that Trampolin employ.

We are obviously liasing  with our Spanish solicitor and will keep you fully updated of the outcome.I doubt that we are the first or will be the last to receive such threats.

We are now getting numerouse telephone calls from Pilar and Marta asking us to sign for the deeds without the licence of first occupation.In addition they are also chasing our agent and solicitor.They are continuing thier threats that Trampolin will cancel the contract if we do not agree.We are doing everything in our power to be ready to complete quickly once the licence is obtained  by processing our application for a mortgage. However we are using a major spanish lender who stipulate that before a mortgage can be issued the licence must be in place and that it is of much  importance for our protection as them. Trampolin are of course suggesting alternative lenders who do not have this condition.

 The licences for this phase were ony applied for on the 23rd January 08 and who knows how long it will be before they are issued.

We are also buying on Trampoline Hills as if that matters to them,and are fast approaching the stage of considering not proceeding and taking whatever action required to recover our deposits and interest.

I agree with Jogary and Shepp that if we all refused to be intimidated and refused to complete without licences it might just give Trampolin food for thought.

We have bought on phase 2 and require a mortgage to complete the purchase. We have previously like others in the same situation, been offered the option of taking possession of our bungalow prior to them obtaining the Habitation Certificate provided we paid Trampolin additional monies upon which we would be provided with builders supply for water and electricity.We have stated to Trampolin from the onset that we would not pay any additional monies until this certificate had been obtained

Earlier this month we started to receive telephone calls from Trampolin requesting us to complete on the basis that the issue of certificates were imminent and that a bank will agree a loan without the certificate and a notary public will prepare and sign deed without the certificate. Our solicitor has now obtained from Trampolin a copy of the application which was made on the 23rd January 08.

We know that as clients we can delay signature of the deed until the certificate is issued however we are now receiving threats from Trampolin that they will cancel the contact. We are reliably informed that we that the only way Trampolin (The Vender) can cancel the contract with us is by way of a Notorial Letter which will not happen as we are protected by Spanish Law.

It appears that with no guarantee of when the certificate will be issued the Developer is facing a major cash flow problem.We would welcome hearing from any other purchasers who have received similar threats or are under similar pressure to complete without the certificate.
