Thank you very much for your clear and concise response.  It was the former - the community went after the developer for defects in the communal parts AND defects to the individual houses.  It was paid out to the community who chose to pay it to themselves. 

 

We didn't make it a condition of sale (in hindsight we should have) but we didn't think we would ever be paid.  A salutory lesson and any one selling should take note.

Hi - this is an unusual request in that I'm sure not too many communities get a claim for poor build quality paid but this has happened in a community where I owned a house (sold in 2012).  We were the original owners, had the cost of putting things right and some of the costs of bringing the case to the courts.  I never thought it would be paid so didn't think too much about it when we sold.  Anyway, the payment has been made to the development and is in the owners' bank accounts including the person we sold to.  Do we have a claim on the payout?  Many thanks for your advice.  And take heart all those who are suing - sometimes you win.
