Hi,

Before I send the letter to Peinsa I will email everyone who responded a copy, also I have listed below everyone who has been included.

Basically I have copied each email & will attach them all to the covering letter, if you want to withdraw I must know before Sat 3rd November 2007.

I think we speak on behalf of everyone but thank you for the time and effort in co-ordinating the compensation letter.

Looks like we may be in for a good party when we all finally move in.

great work roger, hope we all feel the benefit from it. Just to let you know I sent off a similar letter 2 months ago to Peinsa, I would like to say my reply was interesting but I am still waiting for one. Anyway thanks again and if we do get any comp. i am sure the cervesa will be flowing freely for you for some time when we move in (WHEN).

Hi All

My solicitor has had a reply back from the builder and it appears we do not have a claim. However, the builder is offering an upgrade of the following,

  • All bathrooms will be provided with units and mirrors.
  • Upgrade on the door handles (with a more modern style)
  • The kitchen surface will be now of Silestone material and not granite.
  • Italian kitchen units.

 I wonder what the value if this is. I suppose this is better than nothing.

More like the original materials are no longer available!  Would not be a surprise given the length of time we have all been waiting.

I find it a insult that the builders think changing some of the fittings (particularly given there are not many kitchen units to fit etc) compensates for the deposits and interest lost we have all paid.

Wonder if given the posting under another thread re completion dates going into June 08 through to March 09 what the builders will do if 20 plus buyers pull out!  Won't be particular good publicity for them.

Perhaps they think, particularly the english won't do this.

The builders communication with buyers has a lot to be desired, has anyone had any proactive contact from them?  We haven't

If I thought for one minute that there was the remotest chance of getting my deposit back I would be first in the queue. The builders have us over a barrel and they know it.

Hi

I may be able to give you some hope..........

When we spoke to our solicitor in March re compensation etc.  he advised us that basically he would serve notice to complete, knowing that the property cannot be handed over.  This would then result in us being able to back out of the contract if we wanted to.

At the time we did not wish to cancel the contract.

We also have friends who were buying on phase 1, they have gone on to buy a resale in the town.  They received their full deposit back, however no interest.

This did however enable them to buy the property they are now happily using as we speak.

Therefore if you do want to back out you can.  The contact is not one way but a two way agreement, as the builders have not forfilled their part we are at liberty to withdraw.

The builders may find in the next few weeks a number of properties back on their books.  Pitty they have chosen to not communicate with buyers, keeping them in the loop and thereby retaining good relations!

lke most people on this sight we are getting very frustrated with the delays and lack of professionalism from peinsa!!

it is very tempting to cut our losses and either re-invest our money or purchase a resale property!!

what if any are the legal implications of cancelling the contract?

obviously solicitors will have to be paid for work done!

are there any other hidden costs involved?

We canceled our contract september 2006 and received full money back in January 2007 with no charges other than small solicitors fee.Received no interest but full deposit back.In July bought a resale in San Juan and been every 3 weeks since and couldn`t be happier.Calas may eventually be a good development ,but when you are no longer a buyer you realise it is a huge development and certainly won`t be easy to gain regular rent for your property as everyone will want the same thing

We received an email today from our solicitor regarding the compensation it seems quite promising but unfortunately I don't want to put it on the forum

All those  wishing to claim compensation if you would like to see the email then send me your email address and I will forward it on.

Hope you all had a great holiday, the whole lot of the forums seem to be slow in picking up after the hols. We would like to know if you have or have not heard anything as well Roger. We were going to go out to have another look at our property but we decided not to depress ourselves anymore, so we are going to the costa del sol instead to chill out next month.

Hi All,

I only discovered his forum today.  We have a villa in Arboleas which we bought off-plan at exactly the same time as our daughter was seduced into buying a Calas del Pinar  villa at San Juan i.e. April 2004 - both due for completion in May 2006!  Luckily ours was completed on time and we have been monitoring progress on our daughter's property for the past 2 years.  Our solicitor just told us 'don't worry, they're a reliable company and your property is increasing in value all the time'!  That's not much compensation for having 50% tied up for 2 years without any interest or rental income!  We are still resident in UK but are travelling to Spain next week when we shall be trying to get some answers.  We would be very grateful to receive a copy of the compensation letter mentioned in this thread and will send a personal message as requested.  Our property is Plot 38 on Phase 4.  From the photos I can see that there's been  lots of progress since our last visit in November 2007.  We bought through agents Amba Sun.

Really pleased to find this forum and look forward to keeping up-to-date with progress.

As you can see by the dates on the thread it looks like the compensation letter went astray or died. We have been in touch with our solicitor in Mojacar and all they keep saying is that Piensa are a great company and they will be finished, all iwas after was white goods or a funiture pack as comp. but getting nowhere on that. Glad you found this site it is great help at looking at the photos but never any good news on the threads, we would have pulled out long ago if it was'nt for the fact that San Juan is a great place and we are looking forward to living there with our friends Ray and Ann who live a couple of doors away from us in England who are also waiting for there property to be finished. Dont forget any photos while you are out there would be greatly appreciated, we are on plot 53 on phase 7 (which by the way  this is on the slow side) so if you could get a shot for us it would be great thanks.
