Hi Folks, I am just looking for some advice, I heard from "Reclaim in Spain" who are acting on my behalf that the  judgement in May 2020 was awarded in my favour for the full deposit plus interest.

However I am yet to receive anything, I know Covid has had a knock on effect but is this a normal delay?

Hi

It took me 3 years to get the deposit back after winning, then went for the interest and won that case 3 years ago and am told I will get payment this year, but court strikes have been going on for the last twelve months, but having said that I do recommend chasing and challenging, make sure your legal team are aware your waiting.

Do you know if you were awarded costs?

Has your legal team also followed through a claim for costs ?

Have you asked your legal team if they know how the backlog due to strikes in your area have subsequently impacted the timeframe for recovery ? 
 

Have the Bank ( as opposed to court administration delays) been instrumental in adding to these delays? For example have your legal team had to place an enforcement order on the Bank to pay these monies owed according to your successful judicial ruling?

Enforcement actions can also further delay the procedure for return of monies and it would appear that such actions are becoming the norm as Banks sadly purposefully exacerbate an already overstretched justice system. 
If this is the case, have you enquired if you can gain return of costs for enforcement?

Hi Hugh

My understanding is that some of the costs will be covered for the case won for the interest, again it all takes so long I can not recall what I have to pay and what is to be awarded to cover part of the court costs.

your second question I can answer when the cash and final invoice is in my bank, I will just be happy to get something and draw a close to all this, 

The delay with my case has been the court, just waiting for a judge to sign the final settlement number, have just requested my legal team to escalate a complaint process, I am told this will force movement within the court. then i will see if the bank delays, but this did not happen with the deposit refund.

Not doing anything more at the moment as I am told my case and payments should be around May this year, if this does not happen then I escalate again.
