The Developer seems to be making changes which not only effects the bathrooms, but we also find we are losing side windows.  We bought an end terrace which we paid extra for and we now find we have lost our side windows.

Even though we have signed off drawings, and a contract that only permits changes on instructions from the Licensing Authority, changes are being made in spite of our protests. They have told us lies and we are not getting much help from  the promoter.

I would suggest everyone who has bought should watch carefully what is happening to your own house and those who have yet to buy my advice is, be very careful and get written answers to your queries.

Hi Ray

May I ask, how you have discovered that changes are being made to your property ?  What changes are being made to the bathrooms and do you know is this to all of the houses  and as a result is  the price being reduced ?

Have all your dealing been directly with Allied Developments ?

We were given new plans by Allied and found we had lost a bath on suite which has been replaced by a shower. We have lost the bidet on suite, and a dressing area.  Allied tell us that when they came to lay the rooms out internally the the developer found they did not have enough room for two baths etc. Some Architect that designs a house then finds that things do not fit when they start building. 

We found we had no bathroom window; this was said to be a mistake and would be rectified. We had lost a side window in the downstairs bedroom, again we found ths to be accetable as the were installing french doors in the front instead of a window.

However we also found we had lost a side window in the dining room which we are very very unhappy about.  The Developers say that no houses will have side windows as they would effect load bearing walls.  However there is a side window in Number 24 which Carol from Allied was buying. Strange that!

We visited the site on a Sunday morning when the builders were not present and found that we were able walk around and enter the shells with half the locals having a look as well.

They have not offerred a price reduction and we are becoming increasingly concerned what they are up tp  We are again visiting the site on Saturday 5th May 2007.

We are hoping our Solicitor can sort this out, but I am not sure they can. 

Whenever we ask for a change which we are prepared to pay for, Carol of Allied says that now the plans have been passed no changes are allowed. Well we have signed off plans but it  seems as though there is one rule for the  English buyer and another for the Spanish Developer.

How infuriating to be treated this way by Allied, I hope you are able to sort these problems out to your satisfaction.  My payment to them would definately be less the cost of the bidet etc etc

With regard to No 24 one would expect the Sales Director to have the cream of the crop ! but then again every other purchaser should be treated to the cream, as was initially promised by Allied

I would be interested to know if the buyers of numbers 13, 7, and 1 have signed off plans showing side windows.

I have bought a townhouse in Iznajar and am more than happy with the changes made. I do not understand why people are unhappy about this.

Can you confirm what changes have been made to your property and do you consider these to be an improvement ?

Is your property an end Town House like Ray's ?

Dear Weya,

Jo told us that a number of Allied staff were purchasing houses on this development, are you one of them?

We have accepted all the other changes made, however for a Architect to discover during the build phase that their is not enough room in the Bathrooms to cope with 2 baths and 2 bidets as shown on their drawings we find almost unbelievable. We have also in effect currently lost 3 side windows, 2 of which we have accepted

We paid extra for an end terrace because as one example, it also had side windows. We are only seeking to get some of what we paid for.

In addtion we have been consistantly told that NO alterations to the build could be made as the plans as passed  were set "In concrete," even though we  requested some small additions for which we were prepared to pay, because it made good sense to incorporate these during the build.

This will now be tested as we have now made a formal request to the Town Hall to investigate what is going on.

We made it quite clear to Carol of Allied that the side window in the dining room similar to the one in number 24 which was to have been bought by her, was a MUST as far as we are concerned.

We are prepared to take action as necessary to achieve this, and if you read this Carol, do not make the mistake of underestimating our determination.

We are the purchasers of number 7 and were shocked to discover that no windows have been built on this end terrace when we visited last weekend.  We have not been informed of any changes whatsoever from the original plans so were devastated when we actually saw the development. 

We also chose this property for the benefits of an end terrace with more light from windows and views over the town and were prepared to pay a premium for this.  We are unaware of any other changes so I am even more shocked to discover on this website about the removal of some bathroom fitments etc. We have had no contact from the developer about any of this.

We, too, visited the site on a Saturday with only a few workmen present and were able to look around and inside the site.  I have to say that it does not seem like the high spec. finish we were told would be the case.  The tiling looked bottom end of the market and the floor tiles (piled beside the house) felt rough and poor quality.

I am also concerned about the actual size of the property as the so-called walk-in wardrobe shown on the plans now appears to be little more than a fitted cupboard and I have serious doubts as to the actual size of both the house and the grounds.  Is it just me or does the front wall look a great deal closer than the plan would have you believe?

We have not broached the developer about any of this as we wanted to know our rights before approaching them.  We have consulted our Spanish Lawyer who was as equally shocked as we were when he examined the copies of the plans we had been given prior to signing the contract.  He is gioing to contact the developer and find out what is going on. 

Perhaps we should have heard the warning bells when our lawyer asked them to put into the contract that they must inform us of any changes to the development and they refused!!!!

I would be happy for any other owners to contact me further about this matter and I will post any information I receive from my lawyer as soon as I receive it.

I've looked back on a typical layout that Allied sent to me in May last year (via my lawyer) and it clearly indicates at the top of the picture -

"This information has no contractual value. The developer reserves the right to make changes."

I've spoken with Linda at Allied and I'm reasonably happy with the changes. Then again I won't be losing any windows!

You are very lucky in that you have not paid extra for something you haven't got!  The fact remains I would not have paid a deposit on this house if I had seen a plan of the house as it is now and  would argue that the promoter/developer has consequently received my money under false pretences.
