Just a few words to let you all know that i have update the pictures of MHW around all the building side, unlike some people that just show you   the pictures of a small area of the complex that will be finish in one week. (It might is for personal reassons he wants to upset the rest of the buyer)

As you can see, rigth now we are doing the gardening that of course is the last thing to do and working in  the finishing in touch.

Last week, we sent this letter to all your lawyer:

In the name of GPS MAIRENA EL SOTO, L.C. I am pleased to inform you that the Final Completion Certificate for Marbella Hill View Residential Complex is being processed.

However, for your tranquility, we attach a copy of a certificate issued by the architect on the 14^th of December where it is stated that the building works are almost completed, that is to say, 95% of the work has been done.

In any case, as soon as both Professional Associations seal the Final Completion Certificate we will send you a copy in order for you to inform your clients.

The real situation is that Grupo do not want you to know what exactly is going on. Raquel tells you she has placed photos (up to date) and both I and another purchaser have looked and there are no up to date photos. Also (maybe the site is down just now) the website is non existent.  Where is your website Grupo so we can all look at what we are getting for our monies. So we can compare what we are suppose to get and what Grupo have built.  Bloody cockroaches. 

If you click on the shared photos you will see that the 6 pictures uploaded 15th January are the ones that Grupo were referring to as their own. All of the previous 8 pages have been posted by myself. Raquel from Grupo has loaded up pictures that appear to show the development in a better light than what was the actual position. I thought my own pictures taken from  all around the development gave a more balanced view?

There is no doubt that the development is nearly complete but has for "quality" you only need to take a look at a sample kitchen display that would be a dis-service to B & Q or MFI!. Sadly, in the many visits I've made to this sorry development these past 2 1/2 years I just shake my head in disbelief at some of the attrocious quality issues associated with many aspects of the build quality........

This marvellous forum facility that we all share has been infiltrated by Grupo to try and defend their position. They should NOT be allowed to contact investors directly through this forum!!

Of course you are right.  Grupo have only just come out of the woodwork after all of us spending many, many months trying to gain contact with them. They have ignored us all. Now that the site is nearing "completion" (not as far as we are concerned) they act like they are the caring promoters. Of course this is not the case. As far as I am concerned they behave like cockroaches coming out of the woodwork just to feed. When did they ever contact any of us to inform us that the site would not be ready on time, that the technical materials would be changed, that the workmanship was not as they and Viva had told us. When did they inform us that materials would change. When did they inform us that the quality would change. What happened to the high quality apartments "JUST LIKE THE SHOW HOUSE AT EL SOTO". Where are they? If Grupo are monitoring this site now let them be accountable and tell all of us the REAL TRUTH.

Just to let you know that after posting my comments last week and also sending comments to Grupo what do you think? Yes, as usual no response at all.  I am still waiting for the "contact" who contacted me privately with some information. Of course I have responded to this person stating that whatever they say I will keep private. They reckon they have some "insider" information. But to date that person has not come back to me.  If you are that person and you are viewing this mail, please mail me privately and I will get back to you.

Yes I have seen them also. Like we have both said Grupo only want to show us the "good" parts of the development.  I have still not had any response from my comments about the lateness of the completion bearing in mind it's now ONE YEAR late!!! Also I think we would all like an answer to our questions about the quality of the materials used.

I take it you have all seen the photos of the steps going down from the patio to the lower terrace (the level which has the pool etc). On the plans which I brought from the steps were going to be made of stone and enhanced the look of the development but instead of this Gropo have put in what can only be described as a fire escape and im sure this was done to save money and time.

I did bring this matter up with my Spanish lawyer who said “that the plans and drawings that you saw of the project are not binding.  Same are executed in order to give you an idea of what the finished project will look like.  Please note that the Developer is authorized to make changes to the project for technical or judicial reasons.  Furthermore, the Developer does not have to seek the consent of the purchasers to do this.”

As many of you I did ask the developer various questions but all have been ignored. Never again will I buy a property off plan and never again from Gropo

I have noted your concerns. There are a number of us who also find this whole affair farcical. The steps, as you rightly put it are like fire exit stairs, nothing like the brochure which Viva informs me was "only an artist's impression". My argument, and I have told them this, is that Viva told another purchaser who I am in contact with that the plans for the build are exactly as produced and given to the Town Hall.  Therefore if they built according to the plans, (of which we most of us saw when we went up to MHV) then it should be as the plans Viva showed us and not as Viva would have it, according to an "artist's impression." That being the case then why then didn't they put the drawings and plans showing the level of the road lower than that which they have in the brochure. And the apartments set back well away from the road. And how about the wall that surrounds the urbanisation. Blocking out all the views (if any) that we would have had. No-one would have bought a ground floor apartment knowing that their view would have been blocked by a bloody great wall. That was not in the brochure. I tell you why because if they did that then no-one would have bought the bloody apartments. Also I know a few of you have telephoned me with regard to the "fantastic kitchen" that has been installed. Nothing like Viva showed us in the show house apartment.  The quality is terrible. We have a surveyor's report and also other evidence. I am not prepared to discuss here on the forum as I know Grupo is monitoring it. Like Mike says the developer should not be allowed to intrude in on our conversations. It's amazing to hear both Grupo and Viva. Viva are now blaming Grupo and Grupo are blaming Viva for poor marketing. Viva's reresentative told me that it is not them changing the materials, etc it's the developer and also said that this could be done. Yes a change in what goes in for "technical reasons" not changing the bloody thing completely and without warning. Grupo owe us all a duty of care and their behaviour is intolerable. Bloody cockroaches. Don't hear from them from one month to another and then they come out of the woodwork. If anyone wants to speak with me privately and a number of you already have then please do so. There are a number of issues including legal that I can talk to you about but cannot place it hear for obvious reasons. I know I have spoken to about 10 purchasers who are NOT COMPLETING so when Raquel informs us all on the site that things are 95% complete that's not true. There is much more that needs completing before they get the licence. As I said there are many many dissatisfied purchasers who are not completing.
