Yes, we too have to sell our properties and I have one at Manilva Beach - two beds, first floor, overlooking swimming pool and ocean.  All completed - no furniture and willing to accept E170K or negotiate.  In America so you have to dial 001-478-474-1952.  Ours is an end unit and so has a huge patio on two sides which makes the living space even larger. I haven't posted in a while because, like most people who invested in property either for business or pleasure, I am in shock about what has happened to so many people who put their trust and hard earned cash into their futures. I am one of them.  We were all seriously misled by the information given to us at the onset and for the most part none of us did the due diligence required in such a purchase but we relied on the honestly of the solicitors in the UK, the honesty of our Spanish solicitors, the developers and the banks all recommended by the company we dealt with.  This is how all of the money all over the world has disappeared and it is called greed and fraud.

As far as I personally am concerned I can't wait until some heads roll and people end up in jail for fraud and although there has been much printed in the local press in the UK it doesn't seem to really have prevented more people doing the same thing.

I would like to suggest to all of those of you who are being offered a new property somewhere else that you do not accept but that you go and get your money back if you can.  You have to weigh up what has happened to you already which is: you have probably waited 4-5 years for a property which didn't materialize, you have nothing to guarantee the next property (unless you know differently), you will be thinking you can rent or use your new apartment when it is built (none has materialized yet) and you will have nothing but aggravation for years to come setting up your apartment services, snagging, etc.  Just look what you might already have gone through. 

If you are young, in work and can leave this behind and wait for a refund then my own thoughts are that you should.  If you are pensioners or wanting to retire you will still have to wait 4-5 years before the Morocco properties are fully up and running.  Why don't you invest in something that is already built in a country which is treats you and your money as if you count.  Clearly Spain's time is over as regards these new builds as there are hundreds of thousands of them to be finished.  Spain has not made it easy for the tourist with all the high property taxes, etc., etc.  You know how it goes and the red tape in buying there is horrendous. Everyone believes they are escaping the UK weather, etc. etc. but imagine how many vacations you could have had with the money you spent on Spain in one building and all the costs incurred for it.

Lastly, I would like to thank this forum for always letting us vent - we are aware that it was not set up for that purpose but it most certainly has allowed people who share a common problem to come together with a view to trying to resolve it.  Individually nothing can be done but collectively something might be achieved and I hope it is for everyone who has lost track of their money and has nothing to show for it.

For those of you still phoning or writing to OVPI - they don't exist anymore.  For those trying to find CUK and Spanish solicitors - they are all gone.  If your solicitors can find them you might get some satisfaction and money back but who knows.

I am looking for anyone who has not yet taken any legal action to recover monies or has issues with apartment size in the purchase of an Off-Plan apartment, at Manilva Beach or Hacienda Guadalupe using O--I.  It may be that collectively we can reduce the costs of any legal action we will be taking.

I hope you won't mind the intrusion - you can e-mail me separately if you wish after this e-mail if you don't want to get into a discussion with hundreds of others.  Get your money back on this Off-Plan right away if you have any sense of self preservation.  The off-plan sales are a disaster for most people who have gone that route.  I am one of them.  We bought off-plan in October 2003 and the property was completedf in October 2007 but the site was not finished but we had to complete otherwise lose all the money we had already paid to the developer.  To this date the property still has issues and site is not completed.  In our off-plan site we have 277 properties with only very few sold or being used throughout the year.  On the other site again only 14 sold.  Burglary has been a big issue on these sites as well as people being in them illegally and using the facilities without permission.  It has been a nightmare setting up the services on both sites which we are only getting to grips with one year later.  My best advice to you would be to buy something which is already built and has someone living in it and they have no issues with their documents, etc.  Most solicitors in Spain are only conveyancing solicitors who you deal with and they are not equipped to take your developer to court there in Spain if anything happens to the off-plan buying.  There are currently hundreds of people in England and other countries in Europe who have nothign for the money they have paid for their off-plan properties and are trying desperately to get their money back from someone.  DO NOT use any solicitors to convey this property in England or Spain who have been recommended to you by the Off-Plan Sales Person.  They are franchise operators who walk away with your money having sold you a lemon.  Most of them are in financial business usually advisors of some kind and the only person they are interested in is themselves.  You will not get any follow up from them.  Sincerely, C.
