Are the Spanish courts really so busy, my first hearing is in May 2015 that is over a year since taking action.  Maybe another year for second hearing, and another year for the bank to appeal.

By the time i get my deposit back it would have taken about 11 years since putting down my deposit.  I could have done something usefull with that money in that time. 

They are probably hoping we will die and go away before money has to be passed back to us.

Congrats to all that persaveared with this claiming process and have now won through.

I am also with GM Legal and am informed the first court hearing will be heard in May 2015.. That is well over a year since starting the process, Are the courts that busy or are the only opened 2 days a week when it is not holiday time for Spain.

Now the banks are having to pay the process may spead up, can keep appealing if they have to pay more in the end.

I would advise everyone to start their claim now or loose it all now the stupid repayment plan put forward to buy more time has failed.

I agree with the other posts, and for those that voted to continue now have another dession to make.  Keep believing the lies od HDT who have spent YOUR deposits, still have no building permits or funding, Give them another 3 years and things will be allright. OR take action now to recoupe the losses before the banks are able to close the loophold forcing them to cough up our deposits.

My last posting was about a year ago advising the build would not happen and HDT was full of Bull.

I also voted no and am happy for all those who took the legal root and got their money back.  Always said once those brave investers took the legal path in the early days it would open the flood gates for others to follow.

The courts are slow in spain BUT a president has now been set with banks having to repay the deposits.

I was also able to find the money to start an action, about 6 months ago,against the bank in a class action with 6 other people, so hoping after all the banks duckinin and diving they know they have no leg to stand on.

The Court now know the situation but in Spain they can't order a full refund to everyone at once (I would) ONLY those that lawyer up and make a claim.

I would suggest looking through the last posting of Spanish lawyers and sending one of them an e-mail.

Had a recent updat from the builder who says for those who voyed NO to the build we should receive 10% of our deposit this year, with a further 50% next year (if they have any money or don't go bust)

They plan to proceed with the developement but it will be downscaled, but still waiting on planning permits etc.  If you voted yes maybe they don't send out updates?

I also started a class action with Guadalupe back in December and am now informed that now others have signed on Court action is to proceed shortly.

hi Chrisw,  Thanks for your posting and congradulations on getting your deposit back.   All the people like yourself who attempted the court action in the early days showed bravery and should be an inspiration to us all.

A lot of people have probably use all their savings or even remortgaged etc to go for the dream that by all accounts, as you have said, was a no brainer, no way of loosing!  My plan was to rent it out to friends and family and take long holidays for 4-5 years and retire there.

At that time I was a landlord with 3 properties, and fortunate enough not to have to borrow the deposit money.  When it went pear shaped, i was pis---  off with Spain and was not going to throw more money into a legal fight with their corrupt system.

Now we all know deposits can be returned it makes the fight less daunting.  Lets all start claiming.
