 The question to ask Maria de Castro is what status were Martinsa Faldesa Creditors given by the courts and when.

I believe the court dealing with the administration process in the Martinsa case said, shortly after the applications from creditors were made, that creditor purchasers will have what has been commonly called here 'credits against the mass'.  That being the case they were always in a position whereby they would be first in line for repayment.   We do not have that luxury.

MM That is my point and that is what I told them.  Nobody in their right mind would pay them any more money and therefore they would not get the vote required.  I was told that this has been misinterpreted by Daves lawyer.

I rang the company and asked as it did not make sense to me that they want our vote as we have not cancelled our contract but would not give any incentive for us to vote in their favour.  That is what I was told. 

Joanniemac.  That would make sense as one would presume that the court must uphold the law.  Again a question for Martin or any lawyer that would like to assist us on this site.

My understanding is that if you have not resolved your contract and continue with the purchase your credit remains as is and you do not have to pay anything further until the house is built.  If a house is sold to a new buyer then they could possibly be asked for stage payments.

The 65% is applicable to those who want there money back.

Maybe Martin can confirm this on this site.
