has anyone seen the plans for the new builds by al Kaiserslautern which are being built next year

There are two pieces of land near to the Al Kazar. One is between Jardines 13 and Al Kazar and had the foot ball pitchers. There will be villas built there. The second build is opposite Al Kazar and to the left of the neatest if the golf apartments. These are apartments .4 stories high. They differ Olin price I think.the ground and top.floor being the most expensive. Andy at Condado Invest is the guy you need to speak to. Details of both villas and new apartments can be found on Condado Invest web site.

Good morning, we were going to buy a new build apartment on Condada de Alhama and have been asked by the developer to pay € 6000 to reserve.Our lawyer has told us that the law says in Spain buying off plan means that they have to guarantee every payment we make with a bank guarantee? Think they call it "aval" and this is mandatory, Has somebody reserved there already and do they comply with that rule? We are getting conflictive information, the agent says there is no garantee as its not necessary given the size of the developer but we are worried now, so many things are going on today and we would "rather be safe than sorry" after having lost money with a similar thing on the Canaries.Thanks for your comments, Mary

According to this article a new law came into existence in 2015 ( overriding Ley 57/68 for those purchasing offplan after this date).

• Bank guarantees (or insurance policies) securing off-plan deposits are now only valid as from the time a developer has attained a Building Licence. It is therefore important that new-build buyers recognise the need to withhold payment until a developer has secured a valid Building Licence from a town hall’s planning department.

As can be gleaned from the above it stands to logic that a conveyance lawyer must advise his client not to pay any deposit before a Building Licence is issued to a developer. Any interim payment you make prior to its granting will be unsecured and you will be left financially exposed with a risk of losing your deposits. I stress, your deposits are NOT covered by a bank guarantee or insurance policy prior to attaining a Building Licence under this new legislation.”

Even if you do have a BG, as Georgie has identified, it’s proved an extremely lengthy process to recover deposits, and Banks and insurance companies are fighting tooth and nail through the courts ( including the Supreme Court) to try and disclaim and challenge their financial obligations.

Given this background re ongoing litigation, the risks to this form of offplan purchase therefore still appear very high.

I purchased my apartment through Andy in Condado Invest and I found him to be a honest guy who gave us great information I do have to say the deals on Condado is the bank repos I would tread carefully and get as much info as you can

Well this is all very strange, do you want to say that when we pay the deposit we have no guarantees until they achieve the building license?  And we have to trust them once legal to provide such guarantees? Would it not be better then to wait until all is legal? Why would people risk their money for that? This all sounds very dodgy to me, I don't think that's right at all. To make matters worse, my lawyer just emailed me saying we should not proceed for the moment as he can't find the company as legal owner of the land. This company seems not to exist at all and their tax number seems erroneous. Do you have any experience with the developer? HELP!

Just got another email from my lawyer, he says that the land they want to build on is still property of a bank and not the actual developer, is this normal in Spain? He insists we should not sign anything until he agrees, he now says he will contact the town hall for the building license. This is all new to us so we will follow our lawyer's advice for the moment. What do people think who have signed already? And maybe even paid? Will keep you posted as there might be more people in the same position.

You cannot issue a BG if there is no planning licence, do not do it till they have this agreed

I know what is going on here but I cannot publish details on here having recently met with Solomon Homes

If you go onto Condado Invest web site it has all the details for both the new Villas and apartments. Condado Invest has an owner office in Al Kazar

Bottom line appears to be that no one should be placing deposits until a building licence exists, with accompanying legal Bank Guarantee recognised in Spain, and that the secured account details are made available. Otherwise deposited monies will be left at risk, unsecured in the event of breach of contract. Hence the importance to use a trusted INDEPENDENT SPECIALISED conveyancing lawyer, fully knowledgeable of all the pitfalls and protections with regard to offplan purchase.

Quick update, just been informed that there is no building license granted by the townhall so far as the company has not even applied for it, this all looks like a scam to me. We have been told by one agent that we have to sign a due diligence paper to be able to sign the reservation, seems some agents did their homework and are now getting nervous. We will not go ahead with this, and I hope for those who have paid their deposit that it's all a misunderstanding.

thanks for the update.

Do you know what they meant by them asking  you to sign a due diligence paper....does it mean that a purchaser in effect signs away their rights by signing this?

This a an amazing story, are people aware of that? Dont think that EOS is the right forum for that, should be rather on facebook as not many people read nowadays posts on EyeOnSpain I think

This needs to be identified on an open thread rather than a community thread, for others to be forewarned Mariasun.

There could well be other instances where purchasers are being placed at great risk in this manner.

Yes thats correct, we have been presented a paper which we should have signed before signing the reservation and it stated that we accept that we were informed about the fact that the seller is not the owner of the land, building permit not yet granted and that the developer is not disclosing any of the building details as this is pending (no license) and we would receive all this once the sale has gone through. On the other side they stated that the deposit is not refundable. My lawyer searched for the company and could not find them neither, seems their tax number is erroneous. I hope there are not many more people scammed, be aware!

Here are the facts-

FIRSTLY - Solomon Homes are a new developer and have purchased the land on Condado de Alhama. We asked our highly respected lawyers to check them out in the beginning and our lawyers told us that we can be safe in representing this company. The final licences have not been granted yet and this is clearly stated to all of our clients. The deposit of 6.000 euros is held in our client account and will not be passed over to Solomon Homes until the licences are in place and bank guarantees are available, also only when our lawyers give us the go ahead to pay the deposits over. Solomon Homes are in full agreement with this procedure as they are a fully legal and a respectful company. In short all our clients deposits are safe and FULLY REFUNDABLE! 

SECONDLY- Who is Mariasun who signs as Mary and not Maria. I would like you to know who you really are. I would dearly like to be proved wrong when I state that you are not a client but the local agent who holds a grudge because Solomon Homes took away your collaboration agreement to sell their properties because of your mis-representation! The same agent that Condado Invest are suing for defamation! 

Also a very strange coincidence that the post from Mariasun appeared the same day that Solomon Homes officially sent them an email terminating their agreement to sell for them.

Quite frankly its pitiful and adds to the mistrust of our industry which is gained by agents such as these.

If anybody has any doubts about the new build properties, you can speak to the on Site Specialists for the truth as always - Condado Invest.

We are passing this information to Solomon Homes and their legal department will surely be investigation this profile and taking action.
