No we didn't have a bank guarantee. The solicitor managed to find a property with no charges against it and embargoed it. I suppose as we were only owed 26K euros plus legal expenses and interest the developer thought it better to pay up.

The development site we were buying on was closed down in Oct 2005 and has never recommenced.

Is there any mechanism for making a compliant, I don t think 19 months is reasonable time to have to wait for our money.

Hi All

Does anyone know if you make a compliant against a court/judge.

We won our case for return of our deposit and stage payments against a developer in 2009 an the developer paid money into the court in July 2009. We received back the amount we had paid the developer minus legal fees in August 2009.

We are still waiting 19 months later for the court to release the remaining money that covers the legal fees and interest.

Our solicitor (who we have no compliant about, He got our money back when hunres are still waiting) says all they can do is to keep writing to the court/judge to ask for the money to be released.

We are pretty patient an laid back people but think having to wait 19 months is taking the P***

Any information/thoughts welcomed.

We were stranded at Thalassa for 8 days at easter (great shame).

If you keep VAT receipts for meals you should be able to claim them back from the airline under an EC directive (the number escapes me). If you can get a dodgy VAT receipt for accomodation you should be able to claim that back via the airline as well.

I found a standard claims on the internet that I amended and sent off. (if you are with Ryanair the response times not great).

If you want a copy of the letter PM me with an e-mail address.

We have travel insurance through our bank account and had no trouble claiming for additional car hire and the extra cost for our dog in kennels.

You say in one of yur latest posts that intrest costs are calculated to the day, is that the day the developer lodges the monies with courts or the day the court releases the money. If its the datte tthe court releases the money then I see this going on forever, the devloper will never agree to pay an additional 12 months intrest in our case,  Will the courts allow us to accept what the developer paid in to cover legal costs & intrest as full and final settlement we would be quite happy to accept the 8K euros to bring the last 5 years to a close.

Dont hold your breath, its been nearly 12 months now since we won our case and the developer lodged the money with the courts, we have had what was owed since last year but are still waiting for legal fees and intrest.
