Hi

It looks like a minefield, and I will employ the help of a professional I think, but could anyone guide me, ?

If my wife and children move to Spain and take up residency, I than work away in the Middle East and am away for more than 6 month of the year, would I pay income tax in Spain, can I contiune to pay it to UK?

IF WE DO NOT BECOME RESIDENTS - can we still stay in Spain long term and take out private health cover.

The kids will attend a private English school??

Hope someone can assist and provide a steer!!!!

See http://www.eyeonspain.com/forums/posts-long-8916.aspx  about tax. It looks to me as though we would pay more tax in Spain than UK, but I suppose it depends on individual circumstances.

If your family spend more than 183 days in Spain they would have to become residents and either pay into the state health scheme or take out private health insurance.

Yes, you are definitely going to need professional help. You can check the website Absolute Spain as I have posted something on there that may help, but the main thing is that from 6 April 2010 people that claim their tax-free personal allowances based on their commonwealth status are set to lose the allowance (does not apply to EU). It all depends on where your income actually comes from & where you intend to be resident, but you will need a tax accountant that specialises in such matters - one word of advice, make sure they are a Chartered Tax Advisor. You can of course check on HM Revenue & Customs website, and they do have a centre for non residents in Liverpool where you can contact them for basic but specialist advice (but do ask them to put it in writing!).

Depending on where you have your fiscal residency. The two criteria for the consideration of someone as a fiscal resident in Spain are:

Stays of over 183 days in Spain.

Main operation center or activity or financial  base  in a direct or indirect way is in Spain. It may be that due to this as your family live in Spain you might be consider a Spanish fiscal resident.

What do you prefer anyhow?

The kids will attend a private English school?? I cannot see any legal obstacle for that.

Thanks all, we are happy to pay into the system, but are there any rules on (as in UK) NOT PAYING TAX, I think in UK if you spend less than 90 days in the country you do not pay tax is this the same in Spain, even if my family are in Spain.

I think every country is trying to increase it's tax revenue and in the UK the 91 day rule is under attack by HMRC. Speak to a tax specialist !!
