Good Afternoon all,
Been busy today,had to write 2 articles for magazines and thet are being edited today!
At least someone recognizes talent and wisdom when they see it.
Also had clients today wanting to buy something,bloody cheek!
Don't they realise i have the forum to keep an eye on.
A question to predominantly Rixxy,Gillespie or anyone legally minded.
I have a client who has signed a reservation contract with another company and is unhappy with the service and feel they were pressurised into the sale,they have paid the €3000 but only they signed the reservation contract not the sales person!I have tried to call my solicitor for help but they have gone home.Do you think this would stand up or do they have a chance of getting it back?!I have never come across this before.
If anyone cares the fridge is on life support at the minute but it doesn't look good!I may have to break the bad news to the toaster!

Hi Georgia,
Re your unhappy clients, it will really depend on the contract and its terms. Was it a contract signed in Spain, and if any of the actual clauses have been breached by the agents.
If its just they are unhappt with the agents tie then that will not entitle them to the deposit back.
Did they pay it by credit card or was it cheque or cash.
If you can find out a little more then that would help but if only they felt pressurized and now regret signing and paying then they wont really have a leg to stand on.
And once the agent has the dosh then possesion is nine tenths of the law. Even the fact the agent hasnt signed their side, he Im sure will have signed his own copy which will be the one taken into a court room.
