hi,

I`m hoping someone can give me some information, my girlfriend is pregnant and up until september was paying social security, however the job she had ended and obvioulsy so did the social, so im wondering weather or not she will be entitle to have the baby in spain on the state health care, if anyone could kindly answer me on this I would be very grateful.

many thanks

I can't image there would be a problem.

Is she getting unemployment benefit?  If not then she should be as she is entitled to it.

Is she registered as a resident?  If so then I can't see why it would even be an issue.

Justin

Your girlfriend has full rights to health care during the pregnancy, delivery and post partum even if she was here just for a stay, with no residency rights. So... congratulations!

rovision 12 of the Foreigners´ Act, explicitly says:

  1. Foreigners registered in the local census of the town they usually reside , have right to health care under same conditions than Spanish nationals.

  2. Foreigners being in Spain for a stay have right to public urgent health care if they contracted any serious illness or suffered an accident, whatever the cause might be. They will have right to the continuity of that health care till they are discharged.

  3. Minor age foreigners  being in Spain for a stay  have right to health care under same conditions than Spanish nationals.

  4. Foreigner pregnant women being in Spain for a stay have right to health care during the pregnancy, delivery and post partum.
