I would like to hear from anyone who has been through the legal process of getting their deposit back on the grounds of late completion of building works - either successful or unsuccessful.

A Lot depends on how late your property is, the actual circumstances invoved and do you possess an original bank guarantee. Realistically, a year is the optimum time delay to have a good chance of winning in court. Some lawyers will say less but thats the experience I gained from interviewing many litigation lawyers in and around the Marbella district. In thecurrent very slow property market it may well prove very difficult to negotiate a deal with your developer has they have much to lose by returning your deposit? You can win but you must be prepared to go through the full court process!

Hi,just advised the solicitor to cancel our property in Duquesa Fairways Estepona.Its about 4 years in total,almost 2 years overdue.Apparantly the builder has just offered our money back in full.Will wait in anticipation.We have only waited 2 weeks for this information,it seems too good to be true.
Has anyone else experienced this situation in Duquesa.........carol

Hi Carol,
We cancelled our property on ACC and signed the cancellation contract in Nov 06 but are still waiting for the money, hope yor solicitors are better than ours, all we get in reply to our emails is "it is in progress". Good luck.
