How many purchasers have not been given the information about THE CERTIFICATE of HABITATION.   We completed in February 2008 & had never heard of this Certificate of Habitation.  Our Solicitor, The Notary, Agent or Builder had not told us of this important document. 

9 months on and we are in the position that THE ROAD IS NOT MADE & the builder has not completed a few small tasks to allow these 44 apartments obtain the certificate of Habitation.                             

Just over half of the apartments are unsold, Several apartments have perminent residents some of which are tenents of the Builder, many others are owned by people who spend just a few weeks of the year in residence.  We do have an administrator who is not contacting the owners reference the community meeting minutes, our President is very helpful but unable to give the full information because she also has very little contact with our Administrator.

The Builder has not paid the 80,000 bill to the service's providers, the residents are unable to obtain the direct supply from the Electricity & Water suppliers and are still connected to the Builder Supply facility. We have a fund paid by most of the owners to pay the Electricity & Water Suppliers, the builder is not paying for the his tenents supply.  All the owners have however paid the Builder 90 euros in CASH as they requested through the Agent for the individual supply of the services.

Please could anyone help us with some answers,  1) Tell us where we stand regarding the lack of Habitation certificate,  2) Is the Builder allowed to rent these apartments without the Habitation Certificate.  3) Is the Solicitor obliged to tell us of this Certificate of Habitation.

The apartments are situated 25k inland in a Costa Blanca village with very few British residents, The Village is very handy for the coast and has several Supermarkets, Banks, Bars, several other useful shops, internet cafe's, A Bus service to many areas and a town with a train service to Mercia & Alicante approx 7k away. 

I would like to hear from anyone who is in the same position.   regards, DoeDoe.
