Can anybody help.  We have just set up a new community on a recently built site.  In the first meeting a president was elected but we have recently found out that she does not own the property but rents it from a company.  I know that she can have a proxy vote for the owner but can she legally be president.

Horizontal Law, Section 13:2 -

The president shall be appointed from among the unit owners

This woman CANNOT legally be president.

Correct. Presidency is for owners.
Roberto... you are a master of  the Horizontal Property Act.

Beware! To much revision of The Law of Horizantal Property causes incureable side effects! Rantitus for example which I am still taking medication for (mumbas) and also occassional flashbacks quite similar to post traumatic stress.

Other symtoms to watch out for are reading old large files about community matters, either give these away to anyone who wants them or destroy them immeditely otherwise care in the community takes on a whole new perspective.

Philip, you and I are kindred spirits. That's why I've started a new thread for Ex-Presidents, so we don't start to bore other members and begin to sound like Victor Meldrew!

Edited: Silly me, Philip already started a thread for us moaning ex-presidents here See what happens when you retire? Lack of focus leading to memory loss.
