I purchased an off plan property on Mirador de Lobos Golf with the contract stating that the property would be completed and ready for entry in January 2008, with a 3 month overrun.
It is now August 2008 and the developer has yet to contact me with a completion date. As a result of this late completion I am unable to secure a mortgage on this property due to losing my Job at the end of July.
As the developer is in breach of contract and I will be unable to secure a mortgage due to the late completion I have instructed my lawyer to cancel the contract and have the developer return my funds.
It is no surprise that Montana Roja are refusing to do so despite being in breach of contract and are forcing the issue to the Spanish courts. Clearly if the situation were reversed Montana Roja would have no hesitation in enforcing the contract.
I would therefore advise anyone not to deal with Montana Roja.
