I'm thinking of buying an apartment out in Menorca after having had many holidays there over the years. the only trouble is I read somewhere that you need a licence if you intend to rent the property out and that getting a licence is difficult and not guaranteed.

Does anyone have any experience of this?

We too are in the same situation. We have a place in Archena Murcia & are starting to look at rentng this out, We are beginers so are stuck on the legal side of things we require. There seems to be so much to know, not as easy as its made out if you ask me. As your post was a few months ago was wondering if you have any advise you may have picked up since, any help is appriciated. Sarah

the only info I have is what I've been told by an Estate agaent in MAjorca who insisted that 95% of properties do not have this licence and the Tax people are only after the big players.
I'm not sure whether I trust Estate Agents, but I was also told this by my Solicitor when I was looking into buying in Murcia (I was buying a place in Jumilla but the developer went bust - money safe though - phew!)
The problem as I see it is that if you apply for a licence and are denied it then the authorities are aware of you. I really don't know how easy it is to obtain a licence. I would suggest making equires on the premise that you want to buy in your area and see what the council say.

Dear Mickyl:

This issue vary from region to region. It is true that control on these licenses is not too strong at the present moment.

In Islas Baleares there is a Law from 2005.

thanks for replying. 
Are these licences difficult to obtain?
For example if I am thinking of buying in an already establised holiday resort like San Jaime in Menorca.

Is the development classified as " touristic lodge" or are just regular houses in a holiday resort?

For regular houses, there is a classification on regular, superior and excellent holiday houses.

Minimums requirements for regular ones:

 - Six bedrooms and twelve occupants as a maximum.

- Proved quality on building, facilities, finishes  and furnitues.

- Effective system for water and electricty supply and proper treatment and evacuation of sewage waters accoring to the current legislation.

- Fully equipped. Good state of furniture and facilities. 

- Equipped with kitchen tools, crockery, glassware, cutlery adn linen according to the number of occupants.

Superior category needs 100 m2 at least.

Excallent category needs 150 m2 at least.
