Bank Guarantee

Now this may seem like a silly quesion but we have a bank guarantee on our spanish property that expires on April 26th. There have been severe delys to our property and we have asked our solicitor to execute the guarantee. The house has now been given a completion date of April 9th but we still want to get our deposit back and cut our losses. To complicate it further the developers are appaently filing for insolvency.
Are we guaranteed our money back or do we have to fight it? I need to know because if we are not going to get it back then we need to omplete quickly before the developer beomes insolvent!!
