I've been researching whether it's still viable (If it ever was)? to set up a Spanish SL that would own just one Asset "A New Property". The intention would be to reclaim the Purchase Tax at some point within the next 2 years.There are significant costs involved with setting up and maintaining Annual Accounts for the Company but the benefits appear to outweigh the costs!

Has anyone managed to successfully achieve getting the tax back yet and are there any other pitfalls to be aware of?


Reclaim the purchase tax on your property

There is a little known fact that a recent EU ruling has made it possible for individuals and companies to reclaim the IVA (VAT) on the purchase of their property

The refund is claimable 18 months post completion due to the annual basis that IVA reclaims are repaid in Spain, but it is essential that everything is in place prior to final completion and if possible prior to the initial deposit having been paid.

The IVA can only be reclaimed post registration.

The two main criteria to enable you to reclaim the IVA are as follows:

1. The property must be made available for rental with the appointment of rental management agents and property management agents (who clean and maintain the property).

2. The property should be transferred into a Spanish Company, of which you will be 100% shareholder, prior to completion. Spanish Quarters are able to assist you with both of these criteria prior to completion.

Of course you can have a spanish company  (SL) as owner of your property. All the legislation ( regarding VAT) applicable to companies will also be enforceable here.
