ACC a no go area

Hi all,

We are Lin and Terry and we bought on ACC in May 2005 and wrote to Huma last July to cancel. We heard nothing from them and eventually had to instruct a solicitor. Huma even ignored them!!! We are now in the process of taking them to court, hopefully in the next 2 weeks. Huma rang us last week, our first direct contact with them since cancelling, offering us a plot on the new development at a price of 3 years ago. They made it sound such a good offer, when in reality they are giving us nada. Looking at the price lists for ex ACC buyers, they are even 4000 Euros more. The woman from Huma told us that they have no idea if ACC will ever go ahead, certainly not in the near future. We would not touch them with a barge pole now. In fact it is enough to put anyone off Spain for good. You try to protect yourself by buying through a reputable company, ex members of the now non operating Fopdac, and you still get stung. We will be a lot more cautious in future, but even then there is no guarantee it won't happen again. We just want our money back sooner rather than later.

Hi Lin & Terry, isn't it a carry on, poor you & I really do mean that. We hear SO MUCH on EOS & it just goes ON & ON.

Why don't you contact our Maria on EOS, who's a great lawyer who has managed to get many members monies back without too much hassle.

Did you get your Bank Guarantee as, with that, Maria says it's a simple process without needing to go to court.

Hi and many thanks for your reply. As we have already paid out a lot of money to our current solicitor and the lawsuit is already prepared, we will hang on for the time being to see what the outcome is. Unfortunately we never received our bank guarantees, Masa International, our agents, said it was up to Huma to send them, so we have no choice but to take the matter to court. Once again thanks for your comments.

It is illegal for your builder not to have given you a Bank Guarantee when you're buying off plan with stage payments. Masa should have ensured you got it. I bet you were using their recommended lawyer, weren't you ?

Maria doesn't charge for her advice on EOS & she could allay your concerns. It's, of course, up to you whether to contact her. So many members sleep better after Maria has advised, I assure you.

there is a forum on EOS for ACC go to it and you will find a lot of information 

I am surprised that Huma said that it may never be built as the current view is that a decision will be made in February 2008

Many have cancelled and you are quite right , there are some good buys about in Almeria and other parts of Spain

There are also some real professional agents who sell properties in Spain, and also some who do not have any professional  qualifications but run their bussiness properly and give a good service

We are just different to the Masa's of this world who are in effect marketing machines

This is of interest to those who have lost their deposits with Huma.

There is a group action being taken against them on a no win no fee arrangement. The leaders of this group have been very successful with other small group actions against developers, banks etc.. There has to be a limited number in the group. The absence of bank guarantees is not a problem. If you would like to learn more please PM me.

This is not a scam or another waste of time and money. You will see from my previous postings that I am fighting to get our money back for everyone.

With no win no fee what have you got to lose?
