Pressure to Complete

We signed  with Polaris (HR) for an apartment nearly three years ago. We have had a call this week almost demanding we visit and sign in the next two weeks. We were told some months ago that the apartment would not be ready till the new year at the earliest. We have told Polaris that because of business commitments and financial arrangements we can not visit to sign till the middle of February 2008 and they are threatening to cancel the contract (not sure they would, bearing in mind the market !)

We have said we may be prepared to cancel if they can't wait.

Has anyone else had experience of this with Polaris and what the outcome was?

 

If the development is more than 3 months late then you should be able to cancel and get your money back. 

Have you spoken to your lawyer and what has he/she advised?

Getting your deposit back  from developers for late delivery and countless quality issues would be like winning the lottery for my Group of investors!!
Over One year late and 8 months later we couldnt negotiate a settlement with our developer through the courts at the first hearing. Have to wait another 6 months for a full trial to take place! The developer actually admitted that they wouldn be able to sell any of our apartments in the current market place on the CDS!

Hi Mike, great to see you round here again.

I agree, it can be VERY difficult to get a deposit returned but we actually know of a lot of people who have managed it without even having to put up a fight.  So it is possible.  Unfortunately your developer has had all sorts of toubles and will fight till the death.

Its good to know that there are success stories out there. Weve also been trying to identify developments where investors have managed to get their deposits back to help with underpinning our own court case. Any info you have would be gratefully accepted!!

Polaris was on Watchdog last night and they are not coming over as a very nice company to deal with .  Problems with uncompleted sites and exepting peopel to  complete straight away when the urbinasation is not complete , no golf courses built and faiure to return peoples' deposits .

Also  Polaris said in answer to Watchdog that they would only return deposits if they were forced to do so by the courts - now that is a great company to deal with .

Tell all Tamsin. When we rented there, there was a lot of building works going on on a lot of existing properties, foundations being dug up etc.

That's La Torre,so it's got to be the one you stayed at as there is only this one and the Mar Menor site open at the minute.

guess the first one is the one.  It's got that new hotel and spa. Didn't recognise some of the places on there though. We stayed in the houses that look like Balamorey. I suppose they have expanded to build more there then just to confuse me. I don't know!!!!  I'm getting on my own nerves now

My youtube is NOTon La Torre. We are on the Mar Menor Completed on time with no major hassles and very pleased with my home the location and the area in general. Whoever placed this link to my youtube  site can you please remove it as it is of no relavance to your problems at La Torre or any other PW site. I appreciate you have problems by why drag others into them.This  link will only affect me and not POLARIS WORLD who you have issues with.

I think you may have your wires crossed somehere.

None of the people that posted the You Tube link on this thread were in anyway using them as a means of dragging them down,it was purely to show memebers of the forum what a polaris development looked like.

If you read the thread from the start i think this will become apparent.

Georgia is, I feel, correct in his comments, Colb. I also personally think that if you don't want your YouTube video(s) posted on forums or elsewhere if you feel, as you obviously do, that it (they) are being used incorrectly, then maybe you should think twice about putting it (them) on a public website. Just a thought.

Thanks for your reply. Maybe I was a bit rash but in view of all the negative publicity PW are having at the moment it makes people nervous. If you read some of the posts on the polaris world property forum you will understand my concern. Have you been to the Mar Menor resort lately? It is settling down nicely and a real pleasure to spend time on. PW may be dragging their feet but if La Torre and all other resorts turn out like ours it will be well worth the wait. Wishing you all good luck and hope for a speedy completion for you all.

I have been to Polaris Today with clients!!!

So now you can see why i wouldn't rubbish them as i sell for them.

I agree with what you,there maybe some teething problems but it will be very nice in the end.

I was just showing Georgia where we stayed, it was Mar Menor. We had a meal in the hotel on opening night and spent last new years Eve in the piano bar and watched both midnights in London then an hour later in Barcelona on the big screen.

No problems Morerosada I have a broad chin.

Candyfloss we also spent our first christmas there last year. Maybe our paths crossed. We loved it came home so chilled and I don't mean cold. I came home with a sun tan. The pictures on youtube at cabo de palos and the night one at la mange are taken in December.

Yes, we were sunbathing on New years day too, bit too cold for the pool. We didn't buy there but we rented as ours was supposed to have been ready in December but didn't complete until January. We had previously stayed the May before. Have they extended the course yet?
