In a ballot for president is it permitted to exclude

Owners over 75 years of age

Non residnt owners

The retiring president

No, absolutly not, the only owners not able to vote are those that are not up to date with community fees.

 

Here is a English translation of the Horizontal Property Act - courtesy of Castillo Traductores - see section 14 onwards

Thanks for the reply & information.   I didn´t mean exclude from voting, I mean from the actual ballot on who will be president.  Though I think the same woll apply.

Hi, Yes same will apply, nobody can be excluded for the reasons you state - A potential president needs a proposer and a seconder - If two candidates are in this postion it's a vote.

 HPL states a President must  be a owner of a Property, and it´s everybodys duty to take up this position. It says  nothing about the age, gender, nationality, what language you speak, family matters. if they are resident or not there is no excuess to carry out this position.

If somebody is voted in and they think they have a reason not to do it they have 30 days from the AGM to go to court and ask a Judge to be releived of their duty, however remember if somebody goes to court it´s at there own expenes.

  If out going president has to go to court his  fees will be paid for by the community.

So think about it, person taking community to court will be paying for their own fees, and then they will be  contributing to community fees to defend the community, no brainer really.
