Costaluz Lawyers came through for me against BP/Aliseda

I want to share my positive experience with Maria Luisa de Castro's law firm Costaluza Lawyers.

It was supposed to be a refundable deposit that I paid back in September 2012. At that time, I also applied for a 110% mortgage, a deal that Quality Homes was heavily "pushing" then. The reservation agreement stipulated 30 days response but Aliseda/BP took nearly THREE months to let me know of the mortgage application status. The mortgage was not approved at 110% but at considerably less, which I did not want to accept. When I requested my deposit to be refunded, Aliseda actually refused. The agents** EDITED - Against forum rules **were basically useless and would not do anything UNTIL I brought to their attention that agreement terms had been violated: 1) Aliseda took more than 30 days, and 2) that the deposit was refundable (email proof). 

 

Quality Homes put me in contact with someone at Aliseda who passed me to someone else who, again, were useless and basically dragging their feet. Aliseda actually admitted that they did not have a process for refunding deposits..!!!
 
This took until February of 2013, already almost SIX months since I paid the deposit. In Feb/2013, I engaged the services of Costaluz Lawyers.  They went after Aliseda/BP and were instrumental in eventually obtaining my money from Aliseda and send it to me. However, even with the assistance of Costaluz, it was an excruciatingly slow process because Aliseda/BP simply took their time and would not respond to our requests. It took NINE months to finally get my deposit since I only got it Dec 3rd, 2013. That is a full 14 months since I originally paid it.
 
In my case, it was a small amount of money but, out of principle, I was not willing to let Aliseda/BP keep it.

Fantastic work Costaluz.

Presumably this was not an offplan purchase but a reservation agreement and because of the small deposit it was handled via a small claims tribunal...is this correct Maria?

Doesn't this just go to prove how the procedure for swift return of monies (swift by comparison to those who have been waiting for 7 plus years!) can be achieved when consumer rights are fully recognised?

Why can't a specialised court or preliminary hearings similarly swiftly handle Bank claims where developer breach of contract has been proven? It shouldn't depend upon the amount deposited to achieve swift justice but merely recognise inalienable rights as per Ley 57/68?

Well after accepting that I had lost all monies on my attempted Spanish home purchase I see the Ad. on this site placed by CostaLuzLawyers.-No win no fee - After corresponding with them and supplying details they come back to me advising that I have a very good chance of having my money returned. I first have to send them money upfront for various fees. More money into the black hole that is Spain. Thanks but no thanks

Impossible:

I sympathise with your situation and wish we could help you all with no  upfront paymnet . For doing so, I would need to find a sponsor ( I have even been trying this with no success). So... for a good service which tries to keep communication with the client the better we can, we need provision of funds. We are around 20 people working for your cases, doing our best, carrying on even when budget ( due to clients not paying their fees) is not too stable at present.

So, I would ask you too to understand and I promise every penny will be worth it.

I accept what Maria is now clarifying there is a fee structure but, the Ad led people to believe there was  nothing to pay upfront. I would happily pay double any fees if I coul have my monies retrieve first and Allow maria to take her payment direct from these monies

It is true we said fees, instead of provision of funds when refering to initial downpayments. Because we can call it one way or another. These are what are 50% reduced, then no charges as final fee if we lose the case.

Anyhow... you need to freely decide basing your decissions on your own situations, preferences, criteria... That is a healthy market.

I understand the language and translation difficulty but, I am still not fully understanding what Maria is saying. I am not being awkward but this is a legal dispute involving a reasonable amount of money.

What are the fees if it is a win and what are they if we lose

I do not see as the appropriate place for a Law Firm to display its fees but... I am pleased to do it if you want by private message or email.

Provision of funds/ initial downpayment fee is reduced 50%

There will be no final fee ( around 12,5% of claimed amounts) if we lose the case

Is more clear now?

A bit clearer now thank you for patience dealing with my enquiry. I will leave it at that for the moment but, I would be happy to pay 20% if the case was absolutely no payment/fees upfront. Perhaps you could think of me if at any stage you find a sponsor

I think a big issue with this offer is that we still don't know if we have a record of payments into the bank. I thought that the recent court order with the Aifos admistrators was to find this out. I could throw €4500 at it and it could be a waste of time. We need more reassurance than that. A bank gaurantee doesn't mean anything if we haven't got proof of payments to the bank. Can we pay a small fee for this information and then go from there?

Yes, actually, for the preliminary diligences ( in order to obtain the necessary info), the fee is much lower.

4500 includes  lawyers fees +Court Agent +Court fees and expenses related to a First Instance litigation.

We have our deposit back, still fighting the developers for costs and interest. Costaluz Lawyers have worked wonders for us. When we signed for our house with a substantial deposit, the agent who initially adviced us we did not need a lawyer until we received the finished building. Two years past and no building, we were asked to sign to build on another plot by the developers. This we did but I started to get concerned and after reading on eyeon Spain forums I came across Costaluz Lawyers , I contacted Maria and were adviced go forward and cancell the contract. this is where it all started,thankfully.

We won the first instance court case, the banks appealled, we won that aswell.

Maria and her team at Costaluz Lawyers have been super and can't thank them enough.

We can start rebuilding our life.
