Dear Mr Cameron

Please discuss with Sr. Mariano Rajoy the serious issues facing many British Citizens with regards to property in Spain.

We are especially concerned with the victims of Off-Plan Bank Guarantee Abuse. The Banco de España has failed to supervise the Banks in relation to LEY 57/1968 - the Spanish Law that regulates deposits paid for off-plan property purchases.

Many Banks failed to issue the legally required Bank Guarantees. Also on many occasions where the Bank Guarantees were issued the Banks are refusing to honour them.

The Banks colluded with the corrupt property developers to steal innocent purchasers deposit funds.

We had a meeting with David Lidington at the FCO in Sept 2011 to discuss this issue.

Sr. Rajoy should be aware of these serious issues as we had 2 meetings in 2011 with the previous Spanish Government.

I have also contacted Nick Clegg.  He has a Spanish wife and speaks fluent Spanish.

Nick Clegg also had a meeting with Mariano Rajoy yesterday.  This was his second meeting with Rajoy - his first meeting was in Madrid late last year.  Being fluent in Spanish allows Nick Clegg to communicate easily with all the Spanish ministers.

Given his family connections I think Nick Clegg visits Spain regularly.  He must be familiar with the off-plan property abuse and will probably understand the situation better than most of our MP's.

Great news from Spain

2012.02.22 Today there are excellent news for the Santa Ana buyers' who are looking for the refund of their deposits through actions against the Banks under the provisions of the generic guarantee and the 57/68 Act.
The Magistrate's Court from Alicante has rejected the appeal filed by the SGR against a sentence from the First Instance Court nº 6 from Alicante, and has confirmed that the lack of an individual bank guarantee doesn't prevent the purchaser to get the deposit back from the bank under the provisions of the generic guarantee. So SGR has been sentenced to refund the deposit, plus legal interest and the defense cost for the whole procedure.

We still need to keep up the pressure on the politicians to ensure consistent rulings and enforcement of law is done in a timely manner! We mustn't let the Politicians think that a few case wins will suffice.
