WHAT ARE THE FINES FOR NOT SUBMITTING TAX RETURN

Hi wondering whether anyone has any idea what the fine would be for not submitting a tax return.  Story goes, a friend had a business that stopped trading in 2009, the fiscal rep had supposedly suspended the company !!!  It turns out that the hacienda had sent out a tax form for 2010 but it never arrived, ( no postal box number on letter ) therefore he was unaware that the tax office was after him. It appears now that there will be a fine to pay even though there was no income. There is a lawyer and fiscal rep working on it at the moment but we were wondering if anyone is aware of what the fine is likely to be or would it be cheaper to jump ship now with no forwarding address bearing in mind there was no income to declare anyway !!

If you have a lawyer / fiscal rep then you should be directing your questions to them this way you will know what the fine is?

Thanks for friendly advice Goldie !!!!!    Of course they are already in this process however  a little bit of fore warning would have been helpful. Lawyers and fiscal reps like to drag out the conclusion in order to justify their fee's which possibly is larger then the fine itself !!   Normally there are many on here who like to give account of their own wisdom and experience in matters, that is why I asked the question.  Obviously no one else has had this problem !

Hi Toddie, your friend could always go to the tax office in person, if  spanish is limited then it may be cheaper to pay a translator this way you would save on the lawyer / fiscal fees.

I would also ask the lawyer/fiscal how much is there fee to date? as you said there fee could be bigger than the fine.

Spanish tax authorities have ways of finding you out from your NIE number, for none payment can embargo bank account and property.

I spoke to my Lawyers, Manilva Solicitors about this and this is what they said:

"Please note that not having received a letter from the tax offices is not an argument to exclude liability as the submission of declarations is by self assessment, a tax payer must know when he/she is liable to make tax declarations. With regards to the fines it would depend on what has not been complied with i.e. just the submission of the tax form or the payment of any amount due to taxes such as IVA. Apart from the fine if there was an amount due to the tax offices there can also be an over charge on top from 5% to 20% depending on when the money should have been paid to the tax offices. Our suggestion is to visit the tax offices and enquiring on the situation of the file, you will get all information there"
