It looks very unlikely that my apartment will be built and ready before my Bank Guarantee expires in May 2008. Does anyone have any idea what I should do to ensure the guarantee stays in place for another 2 years, god forbid I have to wait that long, but you never know. I just want to keep my money safe!

my bank guarantees expires in sept o8, i have been in contact with calidona and recieved a letter from D Antonio Lopez stating that my bank guarantees will be renewed prior to  to the expiry date of my original guarantees, i recieved this letter dated 13/12/06, i will remind him of his commitment to renew about june time of next year to give them plenty of time to arrange it through the banking system, i will also request that my lawyer sends them plenty of reminders in plenty of time before the expiry date.

i do not want to be in a position were by my deposits are not covered by the bank.

Our lawyer has also obtained a written undertaking to extend the bank guarantees when they expire and is satisfied that this covers us.

we just had ours extended 20 months so get on to your laywer, it is their job to protect you - you have paid them for this already\\ps we are selling ours if anyone is interested as open to offers Crg

Just a reminder for those purchasing on Phase 1. The bank guarantees will now be close to expiry. I requested our soliciter to get these extended - this duly came today and note it has been extended to 31st May 2009

Thanks - I had forgotten that ours was due in the end of March. I have contacted our present MRI recommended solicitors office and have been informed that this is in hand - see what happens. I have asked for a email to confirm that mine have been sent for renewal to Corvera - no reply so far. Interestingly, a recent interview by Justin with Maria de Castro pointed out that recent law suggests that the expiry of these guarantees is no longer valid. I think that this is reassuring but would still like to see my guarantees extended!

Hi everyone. My guarantees expired March 31 2008 and I immediately contacted MRI and my lawyer. That was 2 weeks ago after being assured they would be through in a week.

What I think frustrates everyone on here is the lack of information. I think it would be far better if everyone was more clear and up front. For instance if they don't know something just say that and don't pluck dates out of the air.

As I buyer I've been told there is nothing to worry about and I agree they're building and everything's going forward but I'm a business woman and I never take things on a word and a prayer. Going on good faith on an investment is not a good way to approach things.

I too have been most disappointed with the lawyer provided. As I've part paid for the service can I get out of using them ongoing? does anyone know? I just want a firm that's on the case. I'm hanging in there but after sales and after care is terrible!

Hi lisa mona, on  a previous purchase we switched lawyers.  You just loose the deposit you paid but, for peace of mind, we did not feel that to be a disadvantage.  As it happened our new lawyer helped us get the deposit back on the purchase we were making.  The lawyer we were previously using on that purchase turned out to be one of the builder's daughters!   Anyway, that's in the past, but as far as I am aware it is common practice.

Hi,

I've am in the process of trying to change lawyers, but so far seem to be getting nowhere. My MRI recommended lawyer has already been paid the FULL amount for our purchase at Corvera (They said that this was the way things were done in Spain -  I am  now wiser and hope that no one else falls into that trap).  So far trying to change has been an interesting experience (and this includes solicitors recommended by members of this message board):

1) One solicitor never answered email queries.
2) Another one never answered the questions I specifically asked and sent me back a standard email about her charges. When pushed about reclaiming 50% of fees already paid to the MRI recommended solicitor, they said that they couldn't get involved.
3) Another wants to charge on a fee per-item basis - an excuse to create work for the sake of making a profit.

And the list goes on.....

I'm still looking.

This may sound stupid, but i keep reading all these posts regarding how much everyone is being charged by lawyers and how disappointed the service has been. I bought my property through an agent who is a friend of the family and he advised me not to pay for a lawyer at this point of time. He said it was a total waste of money! The only time he advised me to obtain the services of a lawyer would be when the title deeds are handed over.

I have corresponded with Corvera on a couple of occasions regarding bank guaratees and only once had my agent to help out at no cost. Otherwise , no problems.

I understand and appreciate why people go to lawyers for peace of mind, however after reading all the posts so far it doesn't seem that way.

I was apprehensive at first but now i think he has proved himself correct!

I have tried to send an email to Javier Marin - MRI'S trusted & recommended useless solicitors - this morning and got returned mail

Can anyone confirm the correct email address is javier.marin@legal-independance.com?

Also , has anyone good emails adresses where they actually hear back from for Corvera & MRI?

I watch this space every day & believe I have been extremey patient since I paid up in February 2006 but I have to say this is now growing extremely thin

Try pedro.orgaz@martinezechevarria.com or zana.atiles@martinezechevarria.com we have sent and recieved (eventually recieved) e-mails from these addresses the latter being a little bit quicker.

I queried the bank guarantees yesterday but have had no reply as yet.

Can anyone recomend an English speaking lawyer that is not working for any other firm but themselves, totaly independent from any Estate Agent, contractor or developer.

Hi all,

we use KSI Costa Consulting group based in Marbella, they are English speaking and to my knowledge aren't connected to Calidona in any way. I always get a response and have no complaints with them to date.

I would not be surprised the least if Steve and Jane were correct.

I found an interesting article on bank guarantees available at http://www.spanishpropertyinsight.com/doctor/060326.htm

I have checked that Banco Santander Central is not some mickey mouse organisation. I recently had to ring the MRI recommended solicitor about 4 times before I was honored with an audience over the phone. He confirmed that my bank guarantees had been re-applied for. I asked for email confirmation and received this the same day. Maybe pigs can fly!
