hii All

My lawyer phoned to me friday the 24 of may and she tolded me that we are very close taking over our apartment.

Perla had said that, but we are not sure that we can believe in that? So we are also very interested in hearing from anybody who have got the key to their apartment?

Hi Svend & Karin,

I don't think anyone has completed on their property as yet and obtained the key.  Perla is saying that completion is very near because the developer applied to Fuengirola Town Hall for the most important document: the First Occupation Licence sometime in March last.  This means the Town Hall officials have to carry out an inspection of the development and satisfy themselves that all is in order as far as regulations, planning permission etc are concerned.  If they are satisfied, the licence will be issued and the developer can then proceed to notify purchasers of completion date. If the local authority is not satisfied with some elements of the development or finds that some or other regulation has not been complied with, then issuing of the licence will be delayed until such time as the developer complies or a compromise is agreed. Obviously this process can take time and apparently the norm is anything from 6 weeks to 3 months for the licence to issue barring any major infringements or disputes.  Another factor in delaying the process may be the fact that the local elections for mayor etc in Fuengirola took place last Sunday so before that the focus of the Town Hall was  more than likely on the elections rather than on administrative duties.  Hopefully now that the elections are over  normal administrative activity will resume  and our developer will obtain the licence shortly so paving the way for "getting the key".  Even this process will take time because there are around 200 or so apartments in Phase I and I expect that the maximum number they can hand over per day will be no more than say 5 because of having to make appointments & sign at the notary in each case.  That means it could take 8 weeks or so to complete this and nobody yet knows what order i.e. Block 1, 2 3 etc the developer will follow.  On the positive side I imagine the developer is very anxious to get funds rolling in as soon as possible. I would stress that these comments are my personal opinion only and I may not be correct in every detail.
